Short Answer: What is the G-87 Restriction Code?

G-87 restriction code, regarding foreigners who are evaluated as posing a threat to public order or public security regarding their entry into Turkey is one of the administrative entry ban records that can be applied.

The G-87 implementation is particularly linked to administrative assessments that a foreigner’s entry into or presence in Turkey poses a risk in terms of general security. In practice, this record is referred to as “G-87 General Security.” It is also observed in AYM decisions that the G-87 code is established on the grounds of “general security” and is associated with an entry ban to the country.

However, The presence of a G-87 restriction code does not mean that the person has definitively committed a crime, is a member of a terrorist organization, or has a final conviction against them. The legal basis of the code, the information and documents upon which the administration based its assessment, and the lawfulness of the transaction must be examined separately.

Among the consequences that a foreigner with a G-87 code may encounter are prevention of entry into Turkey, difficulties in visa or residence permit procedures, and, depending on the specifics of the case, deportation proceedings. The legal basis for the entry ban to Turkey is found in Article 9 of the Law on Foreigners and International Protection No. 6458. According to the Law, the entry into Turkey of foreigners who are considered to pose a threat in terms of public order, public security, or public health may be prohibited.

To lift the G-87 restriction code, an administrative application and/or an annulment lawsuit in the administrative court may be brought, depending on the specifics of the case. However, if a deportation decision has also been issued along with the G-87, the specific litigation periods and procedural rules regarding the deportation decision must be taken into account separately.

What Does the G-87 Restriction Code Mean?

The G-87 restriction code is an administrative restriction record applied regarding foreigners.

The term “restriction” herein refers to an administrative record associated with the restriction of a foreigner's entry into Turkey or their legal status in Turkey.

Core concept regarding the G-87 code is public security.

When the administration assesses that a foreigner's entry into Turkey poses a risk to public security, proceedings may be initiated to prevent the foreigner from entering Turkey.

Pursuant to Article 9 of Law No. 6458 on Foreigners and International Protection (YUKK), the Directorate General may, by consulting relevant public institutions and organizations when necessary, ban the entry into the country of foreigners who are outside Turkey and whose entry is deemed objectionable in terms of public order, public security, or public health. The law stipulates that the entry ban shall, as a rule, be for a maximum of five years, but in the event of a serious threat to public order or public security, this period may be extended by the Directorate General for an additional maximum of ten years.

Therefore, one must not confuse the G-87 code with the concepts of an “indefinite entry ban that cannot be lifted under any circumstances.”

The duration and legal consequence of the entry ban must be evaluated based on the specific administrative action and its legal grounds.

Why Is the G-87 Restriction Code Imposed?

The assessments leading to the imposition of the G-87 restriction code may vary from case to case.

In practice, particularly;

    • Individuals assessed as posing a risk in terms of public security,
    • Foreign nationals who have negative assessments by security units,
    • Individuals for whom there are assessments indicating a connection to terrorism or organizations,
    • Foreigners associated with activities deemed objectionable in terms of Turkey's public order,
    • Individuals considered risky within the scope of intelligence information or security assessments

may encounter the G-87 code.

However, there is an important distinction here:

The imposition of the G-87 code does not prove that the above-mentioned matters have definitively occurred.

The lawfulness of the administrative action is evaluated separately.

Particularly, whether the information in the possession of the administration;

    • Is up-to-date,
    • Is genuinely connected to the individual,
    • Is based on concrete information or documents,
    • Whether it demonstrates the individual's personal situation,
    • Whether it is sufficient to legally support the transaction

may be examined.

Does the G-87 Restriction Code Mean That a Crime Has Been Committed?

No.

A G-87 restriction code and a criminal conviction are not the same thing.

Even if there is no final conviction rendered by a criminal court, the implementation of administrative measures against a foreigner by administrative authorities as a result of their evaluations regarding public security is a legally distinct matter.

Nevertheless, the discretionary power of the administration is not unlimited.

The fact that an administrative act has been instituted on the grounds of public security does not mean that the act is exempt from judicial review.

Indeed, in a case brought before the Constitutional Court, it is observed that the G-87 code was established on the grounds of “general security” and an entry ban was enforced.

Therefore, a person against whom a G-87 code has been issued must first seek an answer to the following question:

On what specific grounds was the G-87 restriction code imposed?

Does the G-87 Restriction Code Prevent Entry to Turkey?

Yes, in the event of an entry ban to Turkey associated with G-87, the foreigner may be denied entry into Turkey.

Article 9 of Law No. 6458 permits the prohibition of foreigners from entering Turkey under certain conditions. Furthermore, the official statement of the Presidency of Migration Management specifies that foreigners who are subject to an entry ban will not be permitted to enter the country.

Therefore, if the foreigner is located outside of Turkey, traveling to Turkey without ascertaining the existence of the G-87 code may create serious complications.

In particular;

    • Purchasing a plane ticket,
    • Traveling to Turkey,
    • Arriving at the border crossing

does not, in itself, confer the right to enter Turkey.

If an entry ban is detected during checks conducted at the border gate, the foreigner may be refused entry into the country.

Does the G-87 Restriction Code Affect Foreigners Present in Turkey?

Yes. The G-87 restriction code is not a matter of concern solely for foreigners located outside of Turkey.

It is also possible for it to be issued against a foreigner present in Turkey on the grounds of deportation decision public order or public security.

The official statement of the Presidency of Migration Management indicates that foreigners evaluated as posing a threat to public order or public security may be deported within the scope of Article 54 of Law No. 6458.

Therefore, when the G-87 code is learned, not only the question “Can I re-enter Turkey?” but also:

“Is there a deportation decision against me?”

must be answered.

Are the G-87 Restriction Code and the Deportation Decision the Same Thing?

No.

These two procedures must be distinguished from each other.

G-87 Restriction Code applied to a foreigner is a restriction/entry ban record.

Deportation Decision

is a separate administrative procedure aimed at removing a foreigner present in Turkey from the country.

The presence of a G-87 code regarding a foreigner does not mean that a deportation decision has been issued automatically in every specific case.

However, deportation proceedings may be initiated pursuant to Article 54 of Law No. 6458 regarding foreigners who are assessed to pose a threat to public order or public safety.

This distinction is of utmost importance, particularly regarding the duration of the lawsuit.

Because the legal remedy to be pursued against a restriction code and the remedy to be applied against a deportation decision are not the same.

Which Law is the G-87 Restriction Code Based On?

one of the primary legislations in legal evaluations concerning the G-87 restriction code is Law No. 6458 on Foreigners and International Protection'.

Particularly the Law's;

    • Article 9: Ban on entry to Turkey,
    • Article 10: Notification of the ban on entry to Turkey,
    • Article 54: Deportation decision,
    • Article 53: Judicial remedy against the deportation decision

is significant.

Article 9 of Law No. 6458 regulates that the entry into the country may be prohibited for foreigners who are outside Turkey and whose entry into Turkey is deemed objectionable in terms of public order, public security, or public health. The same article also regulates the lifting of the entry ban or, keeping the entry ban reserved, permitting entry into Turkey for a certain period.

Therefore The removal of the G-87 code should not be evaluated as a legally impossible procedure.

How Long Does the G-87 Restriction Code Remain Valid?

At this point, a significant misconception must be corrected.

It cannot be said that the G-87 code is automatically valid for a specific number of years in every case.

Because a distinction must be made between the restriction code itself and the duration of the entry ban imposed pursuant to Article 9 of Law No. 6458.

According to Article 9 of the LFIP (YUKK), the duration of the entry ban to Turkey as a rule, it is a maximum of five years. In the event of a serious threat to public order or public security, this period may be, by the Directorate General, extended for a maximum of ten more years.

Therefore, a general statement such as “G-87 is strictly a 5-year entry ban” is not accurate.

In the specific case;

    1. What the restriction code is,
    2. The date on which the entry ban commenced,
    3. The duration of the entry ban,
    4. The legal basis of the administrative act,
    5. Whether a new administrative act has been subsequently instituted

must be examined separately.

How to Query the G-87 Restriction Code?

For foreigners, learning restriction codes may not always take the form of a routine internet query.

Foreign national;

    • Directorate General of Migration Management units,
    • Border gate procedures,
    • Visa application,
    • Residence permit application,
    • Entry procedures to Turkey

may learn that there is an entry ban or restriction against them during the process.

In some cases, individuals may encounter this situation at the border gate when they wish to enter Turkey.

Therefore, a foreign national who suspects that there is an entry ban to Turkey should investigate their legal status before traveling to Turkey, is important.

especially if they have previously faced;

    • Deportation order,
    • Criminal investigation,
    • Criminal lawsuit,
    • Security clearance investigation,
    • Residency denial,
    • Visa denial,
    • Compulsory departure from Turkey

the situation must be evaluated separately for individuals who have experienced such a process.

How to Remove the G-87 Restriction Code?

A single method cannot be applied to all files regarding the removal of the G-87 restriction code.

Depending on the circumstances of the specific case;

1. Administrative Application

An application can be made to the administration to request the removal of the restriction code and the associated entry ban.

Legal and factual explanations regarding the individual's situation, along with supporting documents if any, may be submitted with the application.

For example;

    • Criminal record,
    • Decision of non-prosecution (KYOK),
    • Acquittal decision,
    • Court judgments,
    • Family ties in Türkiye,
    • Educational documents,
    • Employment documents,
    • Residence documents,
    • Documents demonstrating that the administrative act is erroneous

may be significant depending on the nature of the case.

2. Annulment Action Before the Administrative Court

If it is considered that the administrative act regarding the restriction code or entry ban is unlawful annulment action in the administrative court may come up.

The competent and authorized court for the lawsuit must be determined based on the nature of the transaction and the authority by which it was issued.

Therefore, instead of generalizations found on the internet such as “G-87 lawsuits are always filed in Ankara” or “always filed in Istanbul”, the specific administrative act must be examined.

Can a Lawsuit Be Filed for the Annulment of the G-87 Restriction Code?

Yes.

If it is considered that the administrative act regarding the G-87 restriction code is unlawful, resorting to administrative judicial remedies may come into question.

One of the fundamental issues in administrative litigation is whether the act is lawful in terms of its elements of;

    • Authority,
    • Form,
    • Reason,
    • Subject,
    • Objective

elements.

Particularly in G-87 files the ground element of the administrative act may constitute a significant subject of review.

For instance, if the administration claims that the foreigner poses a threat to public security, the information and documents supporting this assessment must be legally evaluated.

What Information Does the Administration Submit in a G-87 Restriction Code Lawsuit?

One of the key characteristics of G-87 files is that the basis of the act may contain security or intelligence-related information.

This circumstance may render the lawsuit more complex than a standard administrative action.

Whether all information and documents held by the administration can be openly disclosed to the plaintiff is furthermore subject to legal rules.

Nevertheless, the mere assertion that “intelligence information exists” does not automatically mean that the administrative act is lawful in every case.

The court reviews the lawfulness of the act based on the specific circumstances of the case.

Must the Administrative Act for the G-87 Restriction Code Be Based on Concrete Evidence?

This issue is one of the most critical points in G-87 cases.

The discretionary power possessed by the administration regarding public security does not mean that judicial review is completely eliminated.

Particularly in proceedings that entail severe consequences—such as preventing an individual from entering or staying in Turkey—the legal basis of the action and the specific circumstances of the individual are of utmost importance.

Indeed, in a past administrative court decision, it is observed that the administrative action was deemed unlawful on the grounds that the public security assessment serving as the basis for the G-87 code was not supported by concrete information and documents.

Furthermore, the decisions of the Anayasa Mahkemesi concerning the deportation of foreigners and security assessments underscore the importance of evaluating individual circumstances and concrete risks, as demonstrated in its jurisprudence.

Therefore, in G-87 files, a broader question than simply “is there intelligence?” must be asked:

Is the assessment of the administration of such a nature and sufficiency as to justify the entry ban with respect to the specific individual?

Is an Acquittal Decision Important for the G-87 Restriction Code?

Yes, it is important; however, it does not automatically ensure the removal of the restriction code. Following an acquittal, a separate lawsuit must be filed to have the restriction code removed.

For instance, as a result of a criminal investigation conducted against a foreigner in Turkey;

    • If a decision of non-prosecution,
    • Acquittal decision,
    • Decisions equivalent to non-prosecution

have been rendered, these are documents that can be taken into consideration with respect to the specific case.

However, the legal nature of administrative proceedings and criminal adjudication is different.

Therefore:

“I was acquitted, so the G-87 code will be automatically removed.”

such a conclusion cannot be drawn.

On the other hand, if the acquittal or KYOK decision is directly related to the event alleged to be the basis of the restriction code, this decision may become a significant document in the legal evaluation of the administrative action.

Can a Residence Permit Be Obtained with a G-87 Restriction Code?

Due to the nature of the G-87 restriction code, serious problems may arise regarding residence permit applications. With a 90% probability, it is not possible for a person with a restriction code to obtain a residence permit without the restriction code being lifted.

Because the residence regime regarding the foreigner's presence in Turkey and the evaluations of public order and public security are not independent of each other.

In terms of the issuance of residence permits within the scope of Law No. 6458, the status of the foreigner must also comply with the relevant legislation.

The Presidency of Migration Management states that residence permits are permits that enable foreigners to legally reside in Turkey.

Therefore, if a residence application of a foreigner with a G-87 code has been rejected, not only the outcome of the residence permit application, the actual legal grounds for the rejection must be examined.

Does the G-87 Restriction Code Affect Citizenship Applications?

The application process for Turkish citizenship of a foreigner with a G-87 restriction code may also be adversely affected.

In Turkish citizenship applications, it is crucial to evaluate the foreigner's legal status in Turkey and their implications for public order and security.

However, rather than making a blanket statement such as "anyone with a G-87 code can under no circumstances apply for Turkish citizenship", the legal basis of the citizenship application and the specific reason for the imposition of the G-87 code should be evaluated together.

In particular, different application types such as citizenship by investment, general naturalization, or exceptional citizenship have their own distinct requirements.

Can a Stamped (Annotated) Visa Be Obtained While Subject to a G-87 Restriction Code?

Article 9 of Law No. 6458 governs the permission for a foreigner to enter Turkey for a specified period, without prejudice to the entry ban. Additionally, the admission of certain foreigners into Turkey may be subject to a prior permit requirement due to public order or public security reasons.

Therefore, special visa or entry permit options may come to the agenda in certain cases.

However, this is not the same as the removal of the G-87 code. forgotten.

Permitting a foreigner to enter Turkey for a specific purpose may not mean that the restriction code has been completely deleted.

Does the G-87 Restriction Code Turn into a Deportation Decision?

The presence of the G-87 code alone does not automatically mean a deportation decision in every case.

However, a deportation decision may be issued pursuant to Article 54 of Law No. 6458 regarding foreigners who are evaluated as constituting a threat to public order or public security. This matter is explicitly stated in the official announcement of the Presidency of Migration Management.

Therefore, a foreigner who learns of the G-87 code and is located in Turkey must also investigate;

“Has a deportation decision been issued?”

the question as well.

Can the G-87 Restriction Code and Deportation Decision Be Appealed Simultaneously?

If both administrative actions exist in the specific case, the legal status of the two transactions must be evaluated separately.

For example;

    • The G-87 restriction code,
    • Ban on entry to Turkey,
    • Deportation Decision

may be connected to each other in the same case file.

However, their legal consequences and statute of limitations/filing periods are not the same.

In particular, a special litigation procedure is stipulated against the deportation decision under Article 53 of Law No. 6458.

Therefore, if the deportation decision has been served to the foreigner, it is extremely important not to miss the filing deadline.

What is the Filing Period for a Lawsuit Against a Deportation Decision?

Against deportation decisions within the scope of Article 53 of Law No. 6458 application to the administrative court within seven days from the date of service .

Therefore, for a foreigner against whom a deportation order has been issued in connection with the G-87 code, it is not sufficient to focus solely on the question, “How do I remove the G-87 code?”

First of all:

    1. Is there a deportation order?
    2. When was the decision served?
    3. Has the seven-day period begun?
    4. Is there an administrative detention decision?
    5. Is the person held in a Removal Center?

these questions need to be answered.

Missing deadlines during this process may lead to severe losses of rights.

How Long Does It Take to Remove the G-87 Code?

For the removal of the G-87 restriction code it is not possible to provide a definitive timeframe for every case. However, lawsuits regarding the removal of restriction codes take an average of 6 to 10 months.

The timeframe within which an administrative application will be concluded may depend on the administration's assessment and the nature of the file.

In the event that a lawsuit is filed, however;

    • The workload of the court,
    • The defense process of the administration,
    • The nature of the information and documents in the file,
    • Additional investigations,
    • Requests for information and documents,
    • The evaluation of the request for a stay of execution

such elements may affect the process.

Can a Stay of Execution Be Requested for the G-87 Restriction Code?

If the conditions are met in the specific case, requesting a stay of execution may come into question. However, in lawsuits involving foreign elements, since a decision on the stay of execution is rendered after receiving the defense of the defendant administration, this causes the duration of the lawsuit to be extended.

A stay of execution is not the same as the final annulment of the administrative act.

Is the Court of Cassation (Yargıtay) Competent/Jurisdiction in G-87 Restriction Code Lawsuits?

The G-87 restriction code is fundamentally administrative law and immigration law an issue evaluated within the scope of.

Therefore, regarding the direct annulment of the G-87 restriction code, the primary judicial authority administrative judiciaryis.

Consequently, when evaluating the G-87 restriction code, the decisions of the Council of State and administrative courts, as well as the individual application decisions of the AYM, hold more direct significance.

However, if there is a criminal investigation or criminal case underlying the G-87 code, the following elements in the criminal file:

    • Acquittal,
    • KYOK,
    • Non-prosecution,
    • Conviction,
    • Investigation documents

may carry additional significance in administrative litigation.

How Does the Constitutional Court Approach G-87 Restriction Codes?

In disputes concerning G-87 and the restriction of foreigners' entry into or stay in Turkey on grounds of public security, the decisions of the Constitutional Court serve as an important legal reference source.

In a case previously brought before the Constitutional Court, it is observed that a G-87 restriction code was imposed on the applicant based on general security grounds and an entry ban was enforced.

In another judicial file, the fact that the security assessment relied upon by the administration for the G-87 code was not supported by concrete information and documents posed a problem regarding the lawfulness of the administrative act.

The primary legal conclusion to be drawn from this is as follows:

Public security is one of the significant authorities of the administration; however, while exercising this authority, the specific circumstances of the case and fundamental rights must also be taken into consideration.

Which Documents Can Be Used in a G-87 Restriction Code Cancellation Lawsuit?

Depending on the status of the case, the following documents may be significant:

1. Passports and Identity Documents

Demonstrates the foreigner's identity and legal ties to Turkey.

2. Criminal Record

This may be of particular importance if the G-87 code is related to an alleged crime.

3. Acquittal Judgment

If applicable, the acquittal judgment from the relevant criminal case file may be submitted.

4. Decision of Non-Prosecution (KYOK)

If a decision of non-prosecution was rendered as a result of the criminal investigation, this decision is significant.

5. Residence Documents

These can establish the foreigner's past legal status in Turkey.

6. Documents Demonstrating Family Ties

Having a spouse, children, or other relatives in Turkey may be evaluated within the scope of the specific case.

7. Work and Education Documents

They can help demonstrate the foreigner's social and economic ties in Turkey.

8. Court Decisions

Previously rendered judicial or administrative court decisions may be significant in the evaluation of the case.

However, not every document has the same legal effect in every G-87 file.

What Are the Most Important Considerations in a G-87 Restriction Code Removal Lawsuit?

In a G-87 file, the following headings in particular must be examined:

Basis of the Restriction Code

The grounds on which the code was imposed must be determined.

Date of the Administrative Act

This is important in terms of calculating the statute of limitations for filing a lawsuit.

Notification Status

It must be determined how and when the procedure was notified to the foreigner.

Duration of the Entry Ban

The duration of the ban must be examined.

Deportation Decision

It must be investigated whether there is also a deportation decision against the foreigner.

Criminal Case Files

Investigation or prosecution files that may serve as the basis for the code must be examined.

Justification of the Administration

The connection between the public safety assessment and the specific incident must be established.

Up-to-dateness

It may also be evaluated whether an entry ban is still being enforced based on information from years ago.

Can a Foreigner with a G-87 Restriction Code Grant a Power of Attorney to a Lawyer in Turkey?

Yes, the mere absence of the foreign national in Turkey does not prevent them from granting a power of attorney to a lawyer.

The foreigner can have their legal process in Turkey pursued through a power of attorney issued via a Turkish consulate according to the conditions of the country they are in, or prepared in accordance with the laws of the relevant country and completed with the necessary certification/apostille procedures.

This is particularly important for foreigners who are outside Turkey and cannot come to Turkey due to G-87.

Therefore, the inability of a foreigner to enter Turkey does not mean that they cannot exercise their legal rights in every case.

Can a Foreigner with a G-87 Restriction Code File a Lawsuit Without Coming to Turkey?

Yes, depending on the nature of the specific case, the litigation process can be conducted through an attorney.

The absence of the foreigner in Turkey does not constitute an obstacle in any case to filing an administrative lawsuit or conducting legal proceedings through an attorney-in-fact.

Provided that a duly executed power of attorney is granted to the attorney;

    • A petition of lawsuit can be prepared,
    • A lawsuit can be filed,
    • A reply to the administration's defense can be submitted,
    • Additional documents can be submitted,
    • A hearing can be requested,
    • Court decisions can be monitored.

Therefore, a person with a G-87 code “I cannot enter Turkey, therefore I cannot take any legal action” and such a conclusion is incorrect.

What Should Be Done Before Filing a Lawsuit to Lift the G-87 Restriction Code?

Before filing a lawsuit, the legal status of the file must be clarified as much as possible.

Practically, the following sequence can be followed:

1. The Existence of the G-87 Code is Determined

It is determined which restriction record exists concerning the foreigner.

2. The Entry Ban is Examined

The start and end dates of the ban are investigated.

3. The Deportation Decision is Investigated

For a person currently in Turkey, it is additionally checked whether there is a deportation decision.

4. The Reason for the Restriction Code is Investigated

An attempt is made to determine the grounds relied upon by the administration.

5. Criminal Files Are Examined

The results of ongoing investigations and prosecutions, if any, are evaluated.

6. Litigation Period Is Calculated

The applicable limitation or filing period is determined based on the specific transaction.

7. Appropriate Legal Remedy Is Selected

Administrative application, annulment action, and, if conditions are met, the request for a stay of execution are evaluated.

Most Common Mistakes Regarding the G-87 Restriction Code

1. Mistaking the G-87 Code for a Criminal Conviction

A restriction code is not a criminal conviction.

2. Requesting Only the Deletion of the Code

The grounds for the imposition of the code and the reasons for the unlawfulness of the procedure must be demonstrated.

3. Overlooking the Deportation Decision

A separate deportation decision may also exist regarding an individual with a G-87 code.

4. Missing the Litigation Deadline

Particularly regarding deportation decisions, there are strict litigation deadlines. Lawsuits not filed within 7 days as of notification shall be dismissed.

5. Attempting to Enter Turkey in an Uncontrolled Manner

It is possible for a foreigner who is still subject to an entry ban to encounter issues at the border gate.

6. Failing to Submit Criminal File Decisions

Documents such as acquittal or KYOK (decision of non-prosecution) can be critical in the specific case.

7. Treating Every G-87 File as Identical

The legal basis of the G-87 code is not the same for every foreigner.

Frequently Asked Questions

What is the G-87 restriction code?

G-87 is one of the restriction codes in practice associated with general security and used in connection with restricting a foreigner's entry into Turkey. The legal consequence of the code, along with the entry ban associated with the code and other administrative procedures, must be evaluated as a whole.

Why is the G-87 restriction code imposed?

G-87 may be related to administrative assessments regarding potential risks to general security or public safety. The specific reason for the imposition of the code must be determined through the examination of the case file.

Does the G-87 restriction code mean that I have committed a crime?

No. The G-87 restriction code is not a criminal conviction. The administrative assessment underlying the code and criminal liability are distinct from one another.

Does G-87 prevent entry into Turkey’s borders?

If there is an active entry ban to Turkey associated with G-87, the foreign national may not be permitted to enter Turkey. Article 9 of Law No. 6458 provides the legal basis for the imposition of an entry ban in terms of public order and public safety.

How to remove the G-87 restriction code?

Depending on the specific case, an administrative application may be filed, or an annulment action in the administrative judiciary may be brought. The path to be followed must be determined based on the legal basis of the restriction code, the status of notification, and any other related administrative actions, if applicable.

How long is the G-87 restriction code valid?

It cannot be said that the G-87 code itself has the same validity period in every case. Regarding the duration of the entry ban to Turkey, the time provisions under Article 9 of Law No. 6458 are taken into consideration.

Can one enter Turkey without the G-87 restriction code being lifted?

As a rule, entry into Turkey cannot be made if there is an active entry ban. However, under Article 9 of Law No. 6458, it is possible in certain cases to grant entry permits for a specific period, provided that the entry ban remains reserved.

Are the G-87 restriction code and the deportation decision the same thing?

No. G-87 is associated with a restriction/entry ban record, whereas a deportation decision is a separate administrative action aimed at removing a foreigner present in Turkey from the country.

Can a person with a G-87 restriction code file a lawsuit in Turkey?

Yes. Even if the foreigner is outside Turkey, legal proceedings in Turkey can be conducted through an attorney provided that a properly executed power of attorney is granted.

Is it necessary to come to Turkey to file a lawsuit against the G-87 restriction code?

It is not necessary in every case. Lawsuits and other legal proceedings can be conducted through an attorney depending on the circumstances of the specific case.

Can a person with a G-87 restriction code obtain a residence permit in Turkey?

Due to the nature of the G-87 code and the associated entry/security procedures, serious legal issues may arise regarding residence permits. However, the outcome must be determined based on the specific case file, not solely on the existence of the G-87 code.

Does an acquittal decision lift the G-87 restriction code?

An acquittal decision does not automatically lift the G-87 code. However, an acquittal regarding the criminal case alleged to be the basis of the restriction code can be significant in the legal evaluation of the administrative action in the specific case.

Does a KYOK (decision of non-prosecution) ensure the removal of the G-87 code?

A KYOK decision alone does not result in automatic deletion either. However, if it is directly linked to the basis of the code, it can be an important document during the administrative application or litigation process.

Can a power of attorney be granted to a lawyer for a G-87 restriction code?

Yes. A foreign national residing outside Turkey can execute a power of attorney in compliance with the laws of their country of residence and the formal requirements of Turkish law, allowing them to pursue the legal process in Turkey through their lawyer.

Conclusion and Legal Assessment

The G-87 restriction code is an administrative restriction record that can yield serious consequences under aliens law, particularly arising in connection with an entry ban to Turkey.

However, the presence of a G-87 code does not mean that the foreigner has definitively committed a crime or has a criminal conviction. It must be further examined on what grounds the restriction code was imposed, which information and documents the administration relied upon, and whether these assessments are sufficient regarding the specific individual.

Article 9 of the Law on Foreigners and International Protection No. 6458 permits the banning of entry into the country for foreigners who are deemed sakınca görülen (inadmissible) to enter Turkey in terms of public order, public security, or public health. The same article also authorizes the administration to lift the entry ban or permit entry under certain conditions.

The first action that a foreigner encountering the G-87 code should take is not limited to merely learning the existence of the code. Along with the code, whether there is an active entry ban, the duration of the entry ban, the legal basis of the restriction code, the deportation decision if any, and the relevant lawsuit periods must be evaluated together.

Especially regarding a foreigner residing in Turkey, deportation decision if one has also been issued, the process regarding the restriction code and the process regarding the deportation decision must be separated from each other. The statements of the Presidency of Migration Management indicate that deportation provisions may be applied in respect of foreigners who pose a threat to public order or public security.

On the other hand, it is also important whether the basis of the G-87 code consists solely of abstract, outdated information or information that cannot be sufficiently linked to the individual. In past administrative jurisprudence, there are examples where administrative actions have been annulled because the public security assessment relied upon for the G-87 code was not supported by concrete information and documents.

Therefore, when evaluating the file of a foreigner with a G-87 restriction code, “How to remove the G-87 code?” the following questions must be answered before addressing the question:

Why was the code imposed? What is the duration of the entry ban? Is there a deportation decision? When was the administrative action learned or served? What are the underlying information and documents? Has there been a prior criminal investigation or prosecution? Is there an acquittal or a decision not to prosecute (KYOK)? What are the foreigner's family, employment, education, or residence ties in Turkey?

Without determining the answers to these questions, it is not accurate to make a definitive assessment regarding the probability of removing the G-87 restriction code or the outcome of the lawsuit. Detailed information on restriction codes can be found in Restriction Codes article.
