The death of the Turkish citizen spouse may affect the residence status of the foreign spouse residing in Turkey with a family residence permit and their ongoing Turkish citizenship application. However, identical legal consequences do not arise with respect to the residence permit and citizenship. It is particularly significant whether the citizenship application was filed before or after the death of the spouse.
This article explains the residence permit, citizenship application, general pathway to citizenship, inheritance rights, and legal remedies against administrative procedures for foreign nationals who have lost their Turkish citizen spouses, within the framework of relevant legislation.
Can a Foreign Spouse Remain in Turkey in the Event of the Death of a Turkish Citizen Spouse?
Yes. The death of a Turkish citizen spouse does not mean that the foreign spouse's right to remain in Turkey is terminated in every case and automatically. The seventh paragraph of Article 34 of the Law on Foreigners and International Protection No. 6458 stipulates that in the event of the death of the sponsor, a short-term residence permit may be granted without seeking duration requirements to foreigners who have been residing with a family residence permit dependent on that person.
Therefore, the foreign spouse must evaluate their current residence status and new application requirements without delay. A short-term residence permit is not deemed to be granted automatically; the application must be evaluated within the framework of relevant legislation and current administrative practice.
For general information regarding residence permit types, application procedures, and status changes the residence permit guide in Turkey you may review.
Basic Rule Regarding Residence Permits
If the foreign spouse holds a family residence permit dependent on the deceased Turkish citizen, the possibility of transitioning to a short-term residence permit is evaluated within the scope of Article 34/7 of the Law on Foreigners and International Protection (YUKK). In the event of death, the three-year family residence permit requirement related to divorce does not apply.
However, the validity of the current residence permit, whether there is any cancellation procedure established by the administration, the timing of the application, and whether the foreigner meets other residence conditions must also be examined.
Effect of the Death of the Turkish Citizen Spouse on the Family Residence Permit
Legal Basis of the Family Residence Permit
The family residence permit is regulated within the scope of Article 34 of the Law on Foreigners and International Protection No. 6458. The Turkish citizen spouse may act as a sponsor for the foreign spouse, provided that the conditions in the law are met.
The death of the sponsor creates a legal change in the family relationship upon which the family residence permit is based. However, the effect of this event on the existing permit and the foreign spouse's opportunity to obtain a new residence permit must be evaluated separately.
The current document list of the Presidency of Migration Management and the instructions regarding the specific file must be taken as a basis in the evaluation of the application. For general application requirements, family residence permit requirements and documents explanations regarding this matter may also be reviewed.
Short-Term Residence Permit in Case of the Sponsor's Death
Pursuant to YUKK art. 34/7, in the event of the sponsor's death, a short-term residence permit may be granted, without requiring a duration condition, to those staying on a family residence permit dependent on the sponsor. This provision differs from the duration condition stipulated in the event of divorce.
Law No. 6458 art. 34/7: In the event of the death of the sponsor, a short-term residence permit may be granted, without seeking a duration condition, to those residing with a family residence permit dependent on the sponsor.
Therefore, the fact that the marriage lasted less than three years does not, by itself, eliminate this opportunity for transition. However, for the application to be approved, the relevant residence permit provisions and the conditions required in the specific case must be evaluated.
Regarding the application documents, the Presidency of Migration Management's official residence permit document list must be checked. In this list, the death certificate of the sponsor is among the documents specified for the relevant transition application.
Application Process and Documents
The procedure to be followed for the transition to a short-term residence permit is determined according to the foreigner's current residence status and application type. In general, the following documents may need to be prepared:
- Residence permit application form for the relevant application type;
- Valid passport or travel document;
- Death certificate of the deceased spouse or the necessary official record;
- Current family residence permit card;
- Güncel belge listesinde isteniyorsa geçim kaynaklarını gösteren belgeler;
- Document regarding valid health insurance, to the extent required;
- Documents showing address and accommodation status;
- Photograph, fee, and card fee receipts requested in the current official list.
This list is not a closed document list that will be applied unchanged to every application. Before the application, e-İkamet system and the current announcements of the Presidency of Migration Management must be checked.
Transition to Long-Term Residence Permit
A foreigner who continues to reside legally in Turkey may apply for a long-term residence permit within the scope of Article 42 of YUKK, provided that they meet the requirements. The general rule is to have resided in Turkey with a residence permit for at least eight years without interruption. In addition, other conditions specified in the law, such as income, health insurance, and public order conditions, must also be met.
Within the framework of Articles 38 and 42 of YUKK, half of the student residence permit and the entirety of other residence permits are taken into account in the calculation of residence periods. In the specific case, permit types, interruptions, and statutory exemptions must be evaluated together.
A long-term residence permit is not Turkish citizenship and does not grant Turkish citizenship by itself. For detailed information, long-term residence permit guide can be consulted.
Effect of the Death of the Turkish Citizen Spouse on the Citizenship Application
The acquisition of Turkish citizenship through marriage is regulated under Article 16 of the Turkish Citizenship Law No. 5901. Marrying a Turkish citizen does not automatically or directly confer citizenship. The conditions stipulated in the law must be fulfilled, and an application must be submitted to the competent authority.
Three fundamental conditions stand out in these applications:
- Living in a family union;
- Not engaging in any activity incompatible with the marital union;
- Not having any condition that would pose an obstacle in terms of national security and public order.
For application procedures and up-to-date explanations, the official page of the Directorate General of Civil Registration and Nationality regarding the acquisition of Turkish citizenship may be examined.
Death of the Spouse Prior to the Citizenship Application
The first paragraph of Article 16 of Law No. 5901 provides that foreigners who have been married to a Turkish citizen for at least three years and whose marriage is ongoing may apply for citizenship.
If the spouse has passed away before an application for citizenship through marriage is filed, the marriage is deemed terminated by death. Therefore, merely having been married for three years or more in the past is insufficient for a citizenship application through marriage.
Article 25 of the Regulation on the Implementation of the Turkish Citizenship Law also regulates the situation where the marriage is terminated by death prior to the application date. The requirement for the marriage to be ongoing as of the application date and the procedure to be applied must be evaluated based on the current text of the regulation.
In this case, it is possible for the foreign spouse to transition to a suitable residence or work status in order to continue their stay in Turkey, and to consider the option of citizenship through the general naturalization pathway if the requirements are met. However, the duration of the previous marriage does not automatically fulfill the residency period required for general naturalization by itself.
Death of the Spouse After the Citizenship Application
The second paragraph of Article 16 of the Turkish Citizenship Law No. 5901 contains a specific provision:
In the event that the marriage is terminated due to the death of the Turkish citizen spouse after the application, the condition stipulated in subparagraph (a) of the first paragraph shall not be sought.
According to this provision, if the marriage is terminated due to the death of the Turkish citizen spouse after the application for citizenship through marriage has been duly filed, the requirement of living within a family union is not sought.
However, this exception does not mean that citizenship is acquired automatically. The conditions of not engaging in activities incompatible with the marital union and the absence of any impediment in terms of national security and public order continue to be separately examined.
Records demonstrating that the application was made prior to the spouse's death, application documents, and the death certificate may carry importance in the file. The death must be reported to the application authority and the file must be updated.
Turkish Citizenship Pursuant to General Provisions
For foreigners who lose their spouse before they are able to apply for citizenship through marriage, the possibility of citizenship through general provisions may be separately evaluated. Within the scope of Article 11 of Law No. 5901, the conditions of residing uninterruptedly in Turkey for five years retrospectively from the application date and fulfilling other statutory requirements come to the forefront.
The main conditions within this scope are as follows:
- Having resided uninterruptedly in Turkey for five years in accordance with the law;
- Confirming by actions the decision to settle in Turkey;
- Not having a disease constituting a danger to public health;
- Having good moral character;
- Being able to speak Turkish adequately;
- Having income or a profession to provide for the subsistence of oneself and dependents;
- Not having any condition that would pose an obstacle in terms of national security and public order.
To what extent residence periods shall be taken into account in the calculation of citizenship must be separately examined based on the type of permit and the provisions of the relevant legislation. It should not be assumed that every type of residence permit and the periods spent outside Turkey lead to the same result.
Regarding the rejection of the general citizenship application and the administrative judicial remedy guide on the rejection of citizenship applications can also be reviewed.
Administrative Procedures, Council of State Decisions, and Remedies
Public Order and National Security Review
In citizenship applications through marriage, the other conditions required by the law are evaluated even after the death of the spouse. The exemption of the applicant from the family unity condition does not result in the elimination of the review in terms of public order and national security.
Having a criminal record must not be interpreted as automatically resulting in a denial in every case. The relevant legislation, specific circumstances, nature of the offense, and the rationale of the administrative decision must be evaluated together. The discretionary power of the administration must be exercised within the framework of law and judicial review.
Verification of Council of State (Danıştay) Decisions
If reliance is to be placed on a judicial decision whose case number or date is specified in this regard, the full text of the decision and its relevance to the specific dispute must be verified. The mere presence of the decision in a secondary database does not eliminate the necessity of additionally verifying the official decision text and the scope of the decision.
To verify the decisions of the Council of State (Danıştay), the Council of State Presidency Decision Search System may be used. Without checking the official decision text, it should not be asserted that a specific ruling establishes a definitive legal rule regarding the death of a spouse or a citizenship application.
Lawsuit Against Residence and Citizenship Denial Proceedings
In the event of the rejection of a residence permit or citizenship application, the applicable judicial remedy must be determined based on the legal nature of the proceeding, the authority issuing the act, special statutory provisions, and the date of service.
The general statute of limitations for filing a lawsuit against administrative acts is regulated under Article 7 of the Administrative Procedure Law No. 2577. The general rule is sixty days in administrative courts; however, special regulations and the nature of the specific act must also be checked. One should not rely solely on a general explanation regarding the commencement of the period and the competent court.
Whether a stay of execution can be requested along with an annulment action and the conditions for such a request are also evaluated within the framework of Article 27 of the Administrative Procedure Law (İYUK). A stay of execution is not an automatically granted decision.
For general information regarding the litigation process against administrative acts, administrative law and annulment actions page may be reviewed.
Inheritance and Property Rights of the Foreign Spouse
Statutory Heirship and Inheritance Share
The death of a Turkish citizen spouse may also entail inheritance law consequences for the foreign spouse. Pursuant to Article 499 of the Turkish Civil Code, the surviving spouse is a statutory heir alongside the classes of heirs specified in the law.
- If inheriting alongside the descendants of the decedent, the statutory inheritance share of the surviving spouse is one-fourth.
- If inheriting alongside the mother and father of the decedent or their descendants, the share of the surviving spouse is one-half.
- If inheriting alongside the grandparents of the decedent or their children, the share of the surviving spouse is three-fourths.
- In the absence of other statutory heirs specified by law, the entire inheritance may pass to the surviving spouse.
In determining the shares, the specific family structure, the existence of descendants and other statutory heirs, as well as testaments and other dispositions upon death, if any, must be taken into consideration.
The foreign spouse may request a certificate of inheritance (veraset ilamı) subject to certain conditions. In cases containing a foreign element, the competent authority and the applicable law must be evaluated separately.
Acquisition of Real Estate Through Inheritance
The foreign spouse becoming an heir and being able to permanently retain the real estate acquired through inheritance in their own name are not the same issue. The transfer of the real estate and the foreign heir's ability to maintain ownership are evaluated within the scope of Article 35 of the Land Registry Law No. 2644 and relevant restrictions.
In the specific case, the location of the real estate, applicable statutory limitations, and the capacity of the foreign natural person to acquire real estate must be examined. If retention of the real estate is not possible due to statutory restrictions, liquidation provisions stipulated by law may come into effect. Therefore, it cannot be said that there is a single and invariable outcome for all foreign heirs.
For official legislation and land registry practices of the General Directorate of Land Registry and Cadastre statements must be verified.
Death Pension and Social Security Rights
If the deceased spouse's social security status and premium conditions are met, it may be possible for the foreign spouse to become eligible for a death pension. The granting of the pension is evaluated according to social security legislation, independently of the residence permit or citizenship application.
For premium requirements regarding the death pension, eligibility, and application documents Social Security Institution's explanation on death pension shall be taken as the basis.
Examples That May Be Encountered in Practice
Example 1: Death of the Spouse After Citizenship Application is Filed
If a foreigner who has been married to a Turkish citizen for at least three years has duly filed a citizenship application while the marriage is ongoing, and the spouse passes away after the application, the requirement of living within a family unit pursuant to Article 16/2 of TVK is not sought. The examination of other legal conditions continues. Therefore, it cannot be said that the application will be automatically accepted.
Example 2: Marriage Exceeding Three Years, But Death Occurs Without an Application
The fact that the foreign spouse has been married to a Turkish citizen for six years does not, by itself, enable a citizenship application through marriage to be made after the spouse's decease. The foreigner's residence status is evaluated separately; if the conditions are met, the option of applying for citizenship through the general pathway may be examined.
Example 3: Death in the First Year of Marriage
In the event of the death of the Turkish citizen spouse during the first year of marriage, the foreign spouse may evaluate the possibility of transitioning to a short-term residence permit without the requirement of a duration condition pursuant to Article 34/7 of YUKK, provided that they have stayed on a family residence permit. Regarding citizenship, the application date and other statutory conditions are examined separately.

Frequently Asked Questions
1. When my Turkish citizen spouse passes away, is my family residence permit automatically cancelled?
Death affects the legal basis of the family residence permit. However, the status of the current residence permit document and the transition process to a new residence status must be evaluated separately. Pursuant to Article 34/7 of YUKK, there may be an option to transition to a short-term residence permit without being subject to the duration requirement.
2. Is it required to have been married for three years to transition to a short-term residence permit?
No. In the event of the sponsor's death, the three-year duration requirement is not sought pursuant to Article 34/7 of YUKK. However, the applicant must fulfill the relevant residence permit provisions and other application conditions.
3. My spouse passed away while my citizenship application was pending. Will my file be closed?
If the marriage has terminated due to the death of the Turkish citizen spouse after the application, the requirement of living within a family unity pursuant to Article 16/2 of the TVK shall not be sought. Other statutory conditions shall continue to be examined; citizenship shall not be deemed automatically acquired.
4. We had been married for more than three years, but we had not applied for citizenship. Can I now apply through marriage?
Generally, no. Article 16 of TVK requires the marriage to be ongoing at the time of the application. It may not be possible to apply for citizenship through marriage after the death of a spouse. Citizenship requirements through the general pathway must be evaluated separately.
5. Does a short-term residence permit directly grant the right to work?
No. A short-term residence permit does not grant the right to work on its own. As a rule, for a foreigner to work, they must hold a work permit or a work permit exemption regulated under the relevant legislation. For detailed information to the foreigner work permit guide can be consulted.
6. Can I receive the survivor's pension of my deceased spouse?
If the necessary social security conditions are met, it may be possible for the foreign spouse to become entitled to a survivor's pension. Premium conditions, beneficiary status, and other conditions are evaluated by SGK on a case-by-case basis.
7. Can I receive a share from my spouse's inheritance?
The foreign spouse may be a statutory heir within the framework of the applicable inheritance law and the specific family structure. The inheritance share is determined based on the presence of other heirs and relevant legislation. Whether real estate can be retained in the name of a foreign heir is examined separately.
8. What can I do if my residence permit or citizenship application is rejected?
The grounds for the rejection decision, the date of notification, special application provisions, and the competent and authorized court must be examined. Although the general administrative lawsuit filing period is regulated under Article 7 of Law No. 2577, it should not be assumed that the same period applies to every transaction. A legal assessment of the specific decision must be made without missing deadlines.
Conclusion and Legal Assessment
The death of the Turkish citizen spouse affects the residence and citizenship status of the foreign spouse in various ways. Regarding residence, Article 34/7 of YUKK provides the opportunity to transition from a family residence permit to a short-term residence permit without seeking the duration condition. Regarding citizenship, one of the decisive distinctions is whether the citizenship application through marriage was made before or after the spouse's death.
Death occurring after the application ensures that the condition of living within a family unity is not required pursuant to Article 16/2 of TVK; however, it does not eliminate other citizenship conditions. In the event of death occurring prior to the application, options for obtaining citizenship through the general pathway and transitioning to an appropriate residence status must be evaluated separately.
In each specific case, application dates, permit documents, official records, current legislation, and administrative decisions, if any, must be examined together. This article is for general informational purposes and does not constitute personalized legal advice.
