The eight-year calculation for a long-term residence permit, is conducted by examining the valid residence and work permits retroactively from the application date, rather than from the foreigner's initial entry date into Turkey. Half of the time spent with a student residence permit, and as a rule, the entirety of the time spent with other residence permits, are taken into account in the calculation.

Short answer: Having eight calendar years in Turkey is not sufficient on its own. Residence permit types, gaps between permits, student residence permits, work permit periods, and departures abroad must be examined together. Even if the calculation shows eight years, the conditions for income, health insurance, social assistance, and public order are evaluated separately.

This guide focuses solely on the transition from a short-term residence permit to a long-term residence permit and the calculation of the eight-year period. For all conditions, rights of the permit holder, rejection and revocation lawsuits, our main long-term residence permit guide you may review.

What is the Transition to a Long-Term Residence Permit?

A long-term residence permit is a residence status regulated under Articles 42 through 45 of the Law on Foreigners and International Protection No. 6458, which can be granted indefinitely to foreigners who meet the requirements. It does not begin automatically when the current residence permit expires, nor does the completion of the eight years create an automatic status change. The foreigner must also submit an application and document all requirements.

How is the 8-Year Period Calculated for Long-Term Residence Permit?

First, the application date is determined. Then, all residence permits are placed in chronological order backward from this date. The start and end dates of each period, permit type, gaps between permits, and periods spent outside Turkey are checked individually.

Record to be examined Significance in the calculation
Residence cards and e-residence records Indicates periods of lawful residence.
Passport and entry-exit record Shows the periods spent outside of Turkey.
Student residence permits Only half of the period is taken into account.
Work permits Periods legally considered as residence permits may be taken into account in the calculation.
Extension application documents Görünen boşluğun süresinde başvurudan kaynaklanıp kaynaklanmadığını açıklar.

How is the Student Residence Permit Counted in the Eight-Year Period?

Pursuant to Article 28 of Law No. 6458, half of the period spent with a student residence permit and the entirety of the period spent with other residence permits are counted. Therefore, adding the entire student period to the eight years is erroneous.

Example: Four Years of Student and Four Years of Short-Term Residence

Residence permit type Actual duration Taken into account
Student residence 4 years 2 years
Short-term residence 4 years 4 years
Total 8 years 6 years

Even though the foreigner has actually lived in Turkey for eight years, the calculated period is six years. Prior to other conditions, an additional two-year calculation period must be completed.

Does the Work Permit Duration Count Toward Long-Term Residence?

A valid work permit and work permit exemption confirmation document may be considered as a residence permit within the scope of the conditions stipulated by the law. These periods can be taken into consideration in the calculation; however, the start and end dates of the permits and any gaps in between must be verified. For the relevant regulations, work permit annotations you may review our article.

Do Periods Spent Outside of Turkey Affect the Calculation?

Yes. Interrupted residence is not evaluated solely on the basis of cards succeeding one another. Periods spent outside of Turkey may also affect the calculation. Exceptions in the legislation regarding reasons such as health, education, or mandatory public service in the foreigner's home country must be examined separately.

Every short trip does not automatically reset the previous period. Conversely, having a valid residence card does not mean that all stays abroad are insignificant. An official entry-exit record must be obtained; if multiple passports have been used, older passports should also be evaluated.

How are Gaps Between Residence Permits Evaluated?

If there appears to be a gap between the expiration of a permit and the commencement of the subsequent permit, the reason for this must be investigated. A foreigner's late application is not the same as the administration's delayed conclusion of an extension application made in a timely manner. The application form, application document, notification, and decision dates must be examined together.

Which Statuses Do Not Confer the Right to Transition to Long-Term Residence?

Refugees, conditional refugees, secondary protection status holders, persons with humanitarian residence permits, and those provided with temporary protection cannot benefit from the right to transition to a long-term residence permit. Periods spent under these statuses shall not be added to the eight years solely based on presence in Turkey. For detailed information our guide on humanitarian residence permits you can refer.

Is the Permit Granted Automatically Upon Completion of Eight Years?

No. Eight years of uninterrupted residence is only one of the conditions. The applicant must not have received social assistance in the past three years, must have sufficient and regular income and valid health insurance, and must not pose a threat to public order or public security. These conditions and grounds for rejection in the main long-term residence guide has been explained.

Pre-Application 8-Year Checklist

    1. Determine the date to be taken as the basis for the application.
    2. Chronologically order all residence and work permits.
    3. Calculate half of the student residence periods.
    4. Reconcile the gaps between permits with extension documents.
    5. Verify entries and exits in old and new passports with official records.
    6. Document the reasons for prolonged stays abroad.
    7. Exclude statuses that do not grant the right of transition from the calculation.
    8. Check other application conditions after the period is completed.

Most Common Mistakes in the 8-Year Calculation

    • Accepting the first date of entry into Turkey as the starting point,
    • Including the entire student residence period,
    • Failing to account for periods without a residence permit,
    • Overlooking work permit periods,
    • Failing to investigate the reasons for permit gaps,
    • Checking time spent abroad solely from the current passport,
    • Assuming the eight years is an automatically acquired right.

Frequently Asked Questions Regarding the 8-Year Calculation for Long-Term Residence Permits

Can anyone living in Türkiye for eight years obtain a long-term residence permit?

No. The period must be accurately calculated based on legal residence, and other statutory conditions must also be met.

Is the entire student residence permit added to the eight years?

No. Half of the time spent under a student residence permit is included in the calculation.

Is the time spent with a work permit included in the calculation?

Since a valid work permit can legally be considered a residence permit, the relevant periods can be included in the calculation.

Does a short trip abroad reset the eight-year period?

Every short trip does not automatically reset the period. The total duration and reasons for staying are evaluated within the scope of continuous residence rules.

What should be done if there are gaps between residence cards?

The reason for the gap, the extension application date, and the administrative decision date must be investigated through documentation.

Conclusion

When transitioning from a short-term residence permit to a long-term residence permit, the eight-year period must be calculated accurately.
