In its ruling numbered E. 2023/864 and K. 2024/174, the Siirt Administrative Court found it unlawful to reject the student residence permit extension request of a foreign national who remains an active student at the university on the grounds that the permit was "used outside the purpose of issuance." The Court annulled the rejection administrative act, stating that the administration failed to explain how the misuse was determined despite the interim order and did not present concrete information or documents supporting this allegation.

Short answer: Active student registration does not solely guarantee that a student residence permit will be extended in every case. However, if the administration claims that the permit has been used outside its purpose of issuance, it must be able to demonstrate which concrete facts and documents this conclusion is based on. Since this was not done in the examined case file, the rejection of the extension request was annulled.

The ruling of the Siirt Administrative Court, numbered E. 2023/864 and K. 2024/174, which is the subject of this review, was rendered in the annulment lawsuit filed and pursued by the plaintiff's counsel Atty. Batın Yılmaz The decision is discussed exclusively for the purpose of examining its legal reasoning and practical importance, without sharing data that could reveal the identity of the concerned individual.

How Did the Dispute Arise?

While studying in an undergraduate program at a state university in Türkiye, the plaintiff applied on August 20, 2023, to extend their existing student residence permit. The Provincial Directorate of Migration Management rejected the extension request by an act dated October 2, 2023, stating that it was determined the student residence permit was used outside its purpose of issuance.

The plaintiff's side asserted that their student status and education continued, there was no absenteeism, the administrative act lacked a concrete justification, and they were not granted sufficient opportunity to provide an explanation during the administrative process. The defendant administration defended that the lawsuit was not filed within the statutory timeframe and stated on the merits that it was determined the student residence permit was used outside its purpose and that the act complied with the legislation.

The court first dismissed the defendant administration's objection to the statute of limitations, and then examined the merits of the dispute. Therefore, the decision was rendered not solely on procedural grounds, but as a result of the judicial review of the substantive grounds underlying the rejection act.

Is This Administrative Act an Annulment, a Denial, or a Non-Extension?

The administrative action in the case file is technically not the revocation of a currently valid student residence permit while its term is still ongoing, but rather the rejection of the extension application action. Although Article 40 of Law No. 6458 regulates the denial of a student residence permit, the revocation of a granted permit, and the non-extension of its term collectively, these actions are not the same.

Legal Basis of the Student Residence Permit

In the reviewed decision, Articles 19, 24, 30, 38, 39, and 40 of the Law on Foreigners and International Protection No. 6458 were evaluated. The current text of the Law can be accessed via Legislation Information System The institutional explanations of the Presidency of Migration Management regarding permit types are Types of Residence Permits is located on the page.

Article 24 of Law No. 6458: Extension application

The residence permit extension application is made before the expiration of the current permit. Making the application in a timely manner does not mean that the extension will be automatically accepted; whether the conditions pertaining to the relevant permit type continue to be met is re-examined by the administration. Electronic application procedures are via the e-Residency system of the Presidency of Migration Management carried out.

Articles 38 and 39 of Law No. 6458: Student permit and conditions

Article 38 of the Law regulates the granting of student residence permits to foreigners who will receive associate, undergraduate, graduate, or doctoral education at a higher education institution in Türkiye. Pursuant to Article 39, it is required to submit information and documents supporting the purpose of stay, not to fall within the scope of Article 7 of the Law, and to provide the address information for the stay in Türkiye.

Article 40 of Law No. 6458: Grounds for refusal, revocation, and non-extension

The student residence permit shall not be granted, shall be revoked, or shall not be extended in cases where the required conditions are not met or cease to exist, evidence emerges indicating that the education cannot be continued, it is determined that the permit is used outside the purpose of issuance, or there is a valid deportation decision or entry ban to Türkiye against the foreigner.

In this regulation, the expressions "determined" and "emergence of evidence" are important. The justification of the administrative action cannot be limited to a mere repetition of the statutory provision. A verifiable link must be established between the concrete act of the permit holder and the statutory ground for refusal.

Why Was the Court's Interim Decision Decisive?

The Court, not content with the documents in the case file, issued an interim decision to clarify two matters. On the one hand, information was requested from the university regarding the plaintiff's current student status, and on the other hand, the defendant administration was asked how it reached the conclusion that the student residence permit was used outside its purpose and which documents this finding was based upon.

As a result of the interim decision, it has been confirmed that the plaintiff is an active student in the undergraduate program. No circumstance indicating departure from Turkey, suspension of registration, termination of education, or inability to continue studies has been detected in the case file. On the other hand, the defendant administration has failed to submit concrete information and documents proving the allegation of misuse, nor has it explained through which conduct the foreign national used the permit for purposes other than intended.

At the core of the court's grounds for annulment is the failure of the defendant administration to substantiate the determination of "misuse" despite the interim decision, and the undisputed fact that the plaintiff maintains active student status.

How Should "Use Outside the Purpose of Issuance" Be Substantiated?

The purpose of a student residence permit is for the foreign national to reside within the scope of a genuine and sustainable educational activity in Turkey. Therefore, the administration may examine the authenticity of the student registration, attendance status, actual connection to the program, university notifications, and other facts specific to the case. However, merely writing the general statutory expression into the text of the decision does not, in and of itself, prove misuse.

The reviewed decision does not establish a closed list indicating which document will conclusively prove misuse in every file. Nor is there a general principle in the decision stating that the presence of a disciplinary penalty, academic failure, or employment record will necessarily result in a rejection. The essential point is that the fact relied upon by the administration pertains to the specific individual, has entered the case file prior to or during the administrative act, and its connection to the statutory grounds for rejection is explained.

Element to be reviewedQuestion to be asked in judicial review
Active student statusWas the foreign national enrolled at the university as of the date of the decision and active in terms of student status?
Sustainability of educationIs there evidence indicating that the registration has been suspended, terminated, or that education cannot be continued?
MisuseWhich conduct has the administration characterized as misuse?
Concrete evidenceAre the information and documents supporting this characterization present in the case file?
GroundsHas a clear link been established between the evidence and the ground set forth in Article 40 of Law No. 6458?

Is Active Student Status Sufficient on Its Own?

No. It cannot be concluded from this decision that "the residence permit of everyone who has an active student certificate shall be extended." The other statutory conditions for a student residence permit must also be met. Furthermore, there may be concrete evidence showing that although student registration exists merely in form, the education cannot be pursued, or it may be determined through concrete data that the permit is being used for another purpose.

What determines the outcome in this case is not the mere existence of active student status alone, but rather the fact that, alongside active student status, the administration failed to submit any concrete explanation or document demonstrating the contrary or misuse of the permit. Although the current student certificate can be obtained from the Council of Higher Education student certificate inquiry service on e-Government, university records, attendance information, and the administrative file as a whole must be evaluated together in the dispute.

Did the Plaintiff's Other Allegations Form the Basis of the Ruling?

In the petition, the plaintiff party also asserted that, in addition to the continuation of their student status, the necessary time to submit explanations during the administrative process was not granted. However, the court's grounds for annulment are not based on the acceptance of this allegation. The decision is clearly built upon the determination of active student status and the lack of support for the allegation of misuse with concrete information and documents.

Every allegation put forward in a petition is not deemed accepted by the court. In reviewing a decision, distinguishing between the claims of the parties and the grounds upon which the court bases its judgment is important to avoid portraying the scope of the decision broader than it actually is.

What Conclusion Did the Court Reach?

The Siirt Administrative Court concluded that the conditions stipulated in the Law for the denial, revocation, or non-extension of a student residence permit were not demonstrated in the specific case. The court annulled the subject transaction based on the uncontested fact that the plaintiff was an active student and the administration's failure to submit any concrete information or document to prove the ground of misuse.

  1. For the annulment of the administrative act concerning the denial of the request to extend the student residence permit,
  2. That the financial consequences regarding the litigation expenses set forth in the decision shall be left upon the defendant administration,
  3. That attorney's fees in the amount of 10,500 TL, in accordance with the Minimum Attorney Fee Tariff in effect as of the date of the decision, shall be paid to the plaintiff by the defendant administration,
  4. That the judgment be rendered definitively within the framework of the legal remedy status specified in the decision text,

How Should the Reference to "Finality" in the Ruling Be Interpreted?

In the operative part of the decision, reference was made to Article 53 of Law No. 6458, stating that the decision is final. However, Article 53 is essentially a special regulation concerning the notification, litigation period, and judicial review of deportation decisions; whereas the dispute subject to examination is the rejection of the request for the extension of a student residence permit.

Therefore, said reference should not be generalized to mean that legal remedies are closed for all residence permit rejection or non-extension lawsuits. The potential clerical error nature of the reference in the decision text and the legal remedy status of the specific judgment require a separate procedural law examination. Regarding legal remedies in administrative judiciary, Pursuant to the provisions of the Administrative Procedure Law No. 2577 in effect as of the date of the decision, along with the nature of the dispute, must be evaluated together.

Significance of the Decision in Terms of Enforcement

  • It is not sufficient to merely reiterate the article of the law: How the justification of "use outside the purpose of issuance" materialized in the specific case must be explained.
  • The administrative file must be suitable for judicial review: The information and documents underlying the grounds for refusal must be able to be submitted to the court.
  • The interim decision may ensure the revelation of the material truth: The current information obtained from the university has been compared with the operational basis requested from the administration.
  • Active student status is important but not absolute: If other grounds for refusal set forth in the law exist with concrete evidence, the permit may not be extended.
  • Discretionary power is subject to the review of justification and evidence: While evaluating the residence status of foreigners, the administration must correlate the legal ground with person-specific facts.
  • Each file is evaluated based on its own evidence: This decision does not mean that similar applications will be automatically accepted or that every refusal action will be annulled.

Which Documents Are Crucial in the Lawsuit to Be Filed Against the Denial?

Depending on the nature of the concrete dispute; the reasoned refusal and service document, current residence card, extension application form, documents submitted with the application, current and past student certificates, transcripts, course registrations, attendance records, university correspondence, and the minutes or determinations relied upon by the administration may be examined together. Which document is required varies depending on the grounds for refusal.

Filing a lawsuit does not automatically stay the execution of the refusal action. The foreigner's current legal stay status, the periods specified in the notification, and the conditions for the request for a stay of execution must be evaluated separately. Legal Assessment by Plaintiff's Counsel

According to the evaluation of Atty. Batın Yılmaz The distinguishing aspect of the decision is that it does not accept the concept of “use contrary to the purpose of issuance” in student residence permits as an abstract administrative opinion. The court conducted an investigation before the university and the administration through interim decisions, comparing the verified active student status with the grounds for rejection that the administration failed to substantiate with documentation.

This approach demonstrates that in residence permit disputes, the case file should not be established solely on the student certificate submitted by the applicant. Requesting the grounds for the administrative act, ensuring that university records reflect the situation as of the date of the decision, and questioning the specific act through which the statutory ground for rejection materialized are of concurrent importance. However, since student status, attendance, address, notifications, and administrative findings may vary in each dispute, the decision does not guarantee a specific outcome.

Frequently Asked Questions

Is a residence permit necessarily extended if there is an active student certificate?

No. Active student status is one of the fundamental bases of a student residence permit; however, address, purpose of stay, and other statutory requirements are also evaluated. Furthermore, in the event of concrete evidence indicating that education cannot be continued or that the permit is being used for purposes other than its intended use, the extension request may be denied.

Can the administration issue a rejection decision merely by stating “use contrary to the purpose”?

According to the reviewed decision, this abstract expression alone was not deemed sufficient. The administration must explain through which conduct the use contrary to the purpose occurred and render its findings amenable to judicial review using concrete information or documents.

Are the non-extension and the revocation of a student residence permit the same thing?

No. Non-extension is the failure to grant a new period for the term following the current permit period. Revocation, as a rule, is the termination of an ongoing current permit through an administrative act by its expiration date. Although both are connected to the grounds set forth in Article 40 of the Law, the date and legal consequences of the act differ.

Can a lawsuit be filed against the rejection of an extension application?

Yes. Upon examining the notification date of the reasoned rejection act, the statute of limitations for filing a lawsuit, the competent court, and the documents in the file, filing an annulment action before the administrative court may be evaluated. Filing a lawsuit does not automatically stay the execution of the administrative act.

Is this decision a precedent for all student residence permit rejections?

The judgment provides guidance on substantiating the grounds for misuse; however, the student status, grounds for refusal, and evidence of each case differ. A single first-instance court decision does not mean that all applications will conclude with the same outcome.

Does an annulment decision automatically grant the foreigner a new residence card?

The court's annulment decision eliminates the unlawful refusal act; however, the administrative procedures regarding the issuance of the new card must be carried out in compliance with the reasoning of the decision. The foreigner's current status and subsequent administrative procedures must be monitored separately.

Conclusion

The decision of the Siirt Administrative Court numbered E. 2023/864, K. 2024/174 demonstrates that the student residence permit extension request of a foreigner whose active student status continues cannot be rejected based on the unreasoned ground of "use outside the purpose of issuance". The administration must explain the ground for refusal with individual-specific facts and be able to submit these facts to judicial review with concrete information or documents.

The decision also indicates that active student registration alone does not create an absolute right to a permit. In the legal review, whether the student status is genuine and sustainable, the other conditions in the Law, the findings relied upon by the administration, and the justification of the transaction must be evaluated together.
