In Istanbul and throughout Turkey, individuals who engage in illegal betting generally face an administrative fine, whereas individuals who operate illegal betting, provide locations or facilities for it, mediate money transfers, or encourage individuals to bet may face imprisonment and a judicial fine. Therefore, it must be determined separately through concrete evidence whether a person is merely in the position of a bettor or whether they participate in the organization, financing, access, or promotion of betting activities.
Legal liability in illegal betting penalty cases, is evaluated within the scope of Article 5 of Law No. 7258 on the Regulation of Betting and Chance Games in Football and Other Sports Competitions, which is the primary legislation. Under the same incident, various distinct legal consequences may arise, such as administrative fines, criminal investigations, workplace closures, blocking of access, or administrative actions regarding licenses. The application deadlines, competent authorities, and standards of proof for these sanctions also differ.

Critical Point: Individuals who place bets and individuals who conduct betting operations do not face the same legal consequences. As a rule, individuals who place bets are subject to administrative fines, whereas operators or intermediaries may face criminal liability up to imprisonment. This distinction is crucial in criminal investigations and in challenging administrative fines.
What Penalty is Imposed on Individuals Who Place Illegal Bets?
Pursuant to Article 5/1-d of Law No. 7258, regarding individuals who participate in sports betting or games of chance organized without authorization from the competent authorities administrative fine shall apply. This sanction does not mean that a conviction has been rendered in a criminal court; it is of an administrative sanction nature.
The administrative fine is imposed by the highest local administrative authority. The decision must concretely demonstrate the specific betting activity, date, and the transaction or evidence through which the person participated. A mere abstract denunciation, general law enforcement evaluation, or non-individualized bank movement cannot be accepted as sufficient for an administrative sanction in every case.
Administrative Fines and Judicial Fines Are Not the Same
The administrative fine imposed due to engaging in illegal betting and the judicial fine ordered in a criminal lawsuit are different types of sanctions. An administrative fine is imposed by the administrative authority due to a misdemeanor, and as a rule, an application against it is made to sulh ceza hâkimliği . On the other hand, a judicial fine is a type of penalty ordered by a criminal court due to a crime. It cannot be accepted that a person who places bets is subject to the same sanction regime as the person who organizes bets or mediates money transfers.
