Short Answer: What Must Be Done First If Turkish Citizenship Is Revoked?

If you have learned that your Turkish citizenship has been revoked or that your citizenship decision has been withdrawn, the first steps to take are to obtain the full text of the administrative act along with the service record, determine which article of the Turkish Citizenship Law No. 5901 the decision is based upon, and securely calculate the litigation deadline. In cases where no specific deadline is prescribed, the general statutory period for filing an administrative lawsuit is 60 days starting from the day following the written notification. However, whether the decision was published in the Official Gazette, whether it was separately served to the individual, and when the act was actually discovered must be jointly evaluated for each specific case.

The filing of a lawsuit does not automatically stay the execution of the citizenship revocation or withdrawal act. Therefore, along with the annulment action, if the conditions are met, a reasoned and documented stay of execution request must be prepared. In citizenships acquired through investment, the title deed compliance certificate, official deed, valuation and payment records, bank account statements, foreign exchange purchase certificate, and citizenship application file must be preserved as an integrated whole.

This article is not a general guide re-explaining the concepts of citizenship revocation and annulment. For conceptual distinctions, you can refer to our main analysis titled revocation and cancellation of Turkish citizenship . Here, however, we discuss the steps to be taken by the person upon receipt of the decision, the competent judicial authority, the stay of execution, and the evidentiary strategy demonstrated by a detailed Council of State (Danıştay) interim decision rendered in a citizenship lawsuit.

The First Seven Steps a Person Whose Turkish Citizenship Was Revoked Must Take

1. Determine Whether the Document in Your Possession is a Final Decision or a Warning

Requesting an inspection report from the Land Registry Office, re-evaluating the conformity certificate, requesting a defense by the administration, and the final decision regarding the revocation of citizenship are not the same thing. For example, the inspection report document sent by the land registry office, by itself, may not indicate the termination of citizenship. Conversely, a Presidential decree, a Ministry action, or a decision recorded in the civil registry may constitute a definitive and executory administrative act that can be directly subject to litigation.

2. Record Notification, Publication, and Discovery Dates Separately

The physical notification date of the decision, the record in UETS or another electronic system, the Official Gazette publication date, and the date the individual actually became aware of the decision may not be the same. Retain the envelope, the return receipt (tebliğ mazbatası), and the electronic notification screen. Official Gazette record and, if applicable, UYAP Vatandaş Portal case movement logs. Deadline calculations must be made according to the type of action and the method of notification; one should not rely solely on the assumption that "I saw the decision today."

3. Obtain the Full Text of the Annulment or Revocation Decision

A screenshot showing only the date and number of the decision is often insufficient. The issuing authority, legal basis, reasoning, scope of individuals covered by the decision, and any attached lists must be reviewed. If there is a land registry conformity certificate cancellation, police report, bank record, or another administrative act cited as the basis for the action, their dates and numbers must also be identified.

4. Examine the Legal Status of Each Family Member Separately

The primary investor, spouse, and children may be listed together; however, their methods of acquiring citizenship, the service of the decision upon them, standing to sue, and the claims for relief must be established on an individual basis. Guardianship and representation documents are crucial for minor children, while separate powers of attorney and explicit litigation intent are essential for adult children. Leaving individuals' legal statuses ambiguous within a single family narrative can lead to procedural issues.

5. Maintain the Initial Citizenship File As Is

The application form, passport and civil status documents, eligibility certificate, title deed official deed, valuation report, bank receipts, SWIFT records, foreign exchange purchase certificate, non-sale commitment, and institutional correspondence must be gathered in separate folders. Rather than a summary receipt alone, it is important to obtain a stamped and signed bank account statement or verifiable electronic record, and to ensure that the sender, recipient, description, date, amount, and exchange rate information corroborate one another. For general information on how the investment process is structured, our guide on Turkish citizenship by investment; and for institutional information regarding the methods of acquiring citizenship, the official website of the Directorate General of Civil Registration and Nationality you may review.

6. Do Not Conflate Citizenship Status with Foreigners Law Status

Revocation of citizenship does not automatically entail a deportation decision in and of itself and in every case. However, separate procedures may need to be carried out regarding passports, identification documents, and residence, work, and family residence permits in Türkiye. It must be verified whether the individual holds another citizenship, possesses a valid residence or work permit, has travel needs, and is subject to any separate restriction or deportation order.

7. Formulate the Litigation and Stay of Execution Strategy Together

In an annulment action, it is insufficient to merely state "I made an investment." The elements of jurisdiction, form, grounds, subject matter, and purpose of the administrative act subject to the lawsuit must be explained together with the specific allegations directed against the individual and the chain of evidence refuting such allegations. In the stay of execution section, the current impacts of the loss of citizenship status on civil registry, passport, residence, education, employment, commercial activities, and family life must be substantiated by documents.

Why Does the Designation of the Administrative Act Change the Litigation Strategy?

Although all proceedings are referred to as "citizenship revocation" in colloquial language, there are legally at least three different situations. Since detailed factual and legal explanations are provided in our main guide, their impact on the litigation strategy is summarized here.

Proceeding Legal basis Core question of the lawsuit Primary evidence
Annulment of the decision to acquire citizenship Article 31 of Law No. 5901 Has it been concretely proven that there was a false statement or the intentional concealment of a material fact? Application statements, the individual's knowledge, and their direct connection to the imputed document
Revocation of the citizenship decision Article 40 of Law No. 5901 Was the legal condition actually lacking at the time the decision was rendered, or was the decision duplicative? Legislation in effect on the application date, compliance, and the complete investment file
Cancellation of the certificate of conformity or preliminary review notice Specific legal basis of the transaction and relevant administrative regulations Is this document a final administrative act; should it be litigated separately; what is its impact on the citizenship decision? Certificate of conformity, cancellation notice, notification, institutional transaction file
Rejection of the citizenship application Relevant TVK provision according to the application procedure Is the rejection act lawful when issued before the individual becomes a citizen? Application documents and grounds for rejection

The rejection of a citizenship not yet acquired differs from the revocation of an acquired citizenship. A separate roadmap regarding this distinction is provided rejection of citizenship application in our article.

Within How Many Days and in Which Court Is the Citizenship Revocation Lawsuit Filed?

Pursuant to Article 7 of the Administrative Procedure Law No. 2577, in cases where no specific period is prescribed in special laws, the general statute of limitations for filing a lawsuit in the Council of State and administrative courts is 60 days. As a rule, this period begins on the day following the written notification. However, in cases where the citizenship decision has been published in the Official Gazette, separately served, or where no service document exists at all, the starting date must be evaluated on a case-by-case basis.

The competent judicial authority is also determined according to the authority indicated on the decision. If the revocation of citizenship is established by a Presidential Decree , then, Article 24 of the Council of State Law No. 2575 comes to the agenda for Danıştay to act as a court of first instance. In contrast, the competent and authorized court against a final act of the Ministry, governorship, population directorate, or another administrative authority may not be the same.

Important: It should not be assumed that every application made to the administration will suspend the litigation period. Whether the application falls within the scope of Article 11 of İYUK, the date on which it was made, whether a response was given, and the remaining time must be calculated separately. The existence of strong material evidence after the expiration of the time limit does not automatically eliminate the risk of the lawsuit being dismissed on procedural grounds due to time-bar.

Why Must Stay of Execution Be Justified Separately and Concretely?

Filing an annulment action does not automatically stay the execution of the administrative act. Pursuant to Article 27 of İYUK, two conditions must be jointly demonstrated for a stay of execution:

  • The administrative act being clearly unlawful,
  • The execution of the act causing damages that are difficult or impossible to compensate.

Regarding clear illegality; it is discussed whether the transaction is based on a real and personalized ground, whether the conditions for revocation or annulment existed as of the date of the decision, whether the decision is reasoned and reviewable, and whether the individual was granted the opportunity for defense or explanation. Regarding damages that are difficult to compensate, current documents must be submitted instead of the abstract statement "I will suffer victimization."

Area of damage Examples of documents that can be submitted
Identity and travel Identity/passport transaction records, upcoming travel and visa documents
Family life Marriage and civil registry records, status of family members, maintenance obligations
Children's education School records, exam and enrollment attendance documents
Employment and commerce Employment contract, company records, signatory authority, ongoing contracts
Healthcare Ongoing treatment and health insurance documents
stay in Turkey Residence registration, applications regarding foreign national status, and other administrative procedures

What Interim Decision Did the Council of State Render in the Case Handled by Our Office?

In a case handled by our office under power of attorney—where the parties' personal information is kept anonymous in this text—the annulment and stay of execution of the Presidential Decree concerning the revocation of Turkish citizenship exceptionally acquired through investment, pursuant to Article 40 of Law No. 5901, were requested. Published decisions regarding citizenship disputes can also be searched through the Danıştay Case Search system, with personal data anonymized.

In its interim decision dated July 29, 2026, in file numbered E. 2026/5555, the 10th Chamber of the Council of State (Danıştay) requested detailed information and documents from multiple institutions to clarify the dispute, rather than immediately granting or denying the request for a stay of execution. The court decided to review the request for a stay of execution after receiving the defenses and interim decision responses of the defendant administrations or after the expiration of the response periods.

Why is the Interim Decision Important in Practice?

The interim decision demonstrates that a citizenship dispute cannot be resolved with a single-sentence acceptance stating merely that "the certificate of conformity has been revoked." The court has requested—separately—the initial citizenship decision, the revocation decision, the notification, the administrative justification, investment and payment documents, any potential criminal investigation, international judicial assistance records, and national security and public order data.

This approach reveals that the petition must respond not only to the final administrative act, but to the entire chain of acts constituting it. Even in cases where the administration relies on a broad report or a collective list, it must be examined whether a concrete link has been established between the individual concerned and the alleged unlawfulness.

The Evidence Map Established by the Council of State Interim Decision

Article 20 of the Administrative Litigation Procedure Law (İYUK) empowers administrative judiciary authorities to conduct all kinds of investigations ex officio regarding the cases pending before them, and to request necessary information and documents from the parties or relevant authorities. In the interim decision we examined, this investigative power has materialized under the following headings.

Authority from which information is requested Subject matter investigated by the court Practical implications for the plaintiff
Defendant administrations Decision to grant citizenship, revocation decision, grounds, supporting documents, and service records The grounds, scope of the administrative act, and the commencement of the limitation period for filing a lawsuit must not be left ambiguous.
Ministry of Justice Whether there are any documents or information transmitted concerning individuals pursuant to a request for letters rogatory or extradition If there is an allegation originating from abroad, its source, content, and connection to the individual must be established.
Ministry of Justice / judicial records Whether there is any ongoing judicial investigation or prosecution in Turkey and the relevant case files An allegation in a collective report and an actual judicial file initiated against an individual must not be treated as identical.
Presidency of the National Intelligence Organization Whether there is any adverse information or document concerning national security and public order The basis of the abstract security assessment and its individualization must be amenable to judicial review.
Directorate General of Security Negative information or documents concerning national security and public order A distinction must be maintained between administrative law enforcement records and criminal investigations.
General Directorate of Land Registry and Cadastre Whether the real estate investment determination/compliance certificate has been revoked; the transaction file including the foreign exchange purchase certificate and bank receipts It is observed that the investment is examined not only through the title deed registration, but also together with the valuation and payment chain.
General Directorate of Land Registry and Cadastre Whether a notification or complaint has been filed with the prosecutor's office due to the revocation of the compliance certificate, and the status of the investigation Administrative suspicion, denunciations, and final criminal determinations must be separated from one another.
General Directorate of Land Registry and Cadastre Whether the revocation of the compliance certificate was served on the individual and whether a separate lawsuit has been filed against this action The finality andjusticiability of the prior administrative act underlying the decision to revoke citizenship must be separately investigated.

Why Interim Decision Responses Can Change Litigation Strategy

In an official response received pursuant to an interim decision, it was reported that, based on current records within the relevant unit's jurisdiction, no file record regarding a judicial rogatory letter or extradition request concerning the plaintiffs was found. In another response, it was explained that judicial file inquiries can be conducted through the UYAP screens of the Council of State. These responses alone do not conclude the case; however, they are important for testing which official records support the grounds put forward by the administration.

Therefore, when an interim decision response is received, one should not settle simply for a "positive" or "negative" label. The response must be examined to determine which institution's scope of duty is covered, which database was queried, what the date is, and whether there are any attachments to the response. Requesting an additional interim decision may be brought to the agenda in the event of incomplete or contradictory responses.

Why Is Individualization Important in Citizenship Proceedings Based on a Collective List?

In the administrative documents we reviewed, it is observed that numerous primary investors and family members are evaluated within a broad list, and procedures regarding compliance certificates and citizenship status are conducted through this general report. Conducting a collective examination may be a result of the administration's inspection authority. Nevertheless, the following questions must be answered separately for each individual:

  • Which real estate property did the relevant person acquire, on what date, and for what consideration?
  • From which account to which account was the payment directly made?
  • What is the concrete connection of the individual to the document alleged to be forged or contrary to the truth?
  • Has the individual's knowledge and intent regarding the preparation or use of the document been demonstrated?
  • Has the ground for revocation of the conformity certificate been explained in a manner specific to the individual and the real estate property?
  • Are there separate decisions and service of process concerning the spouse and children?

In revocations within the scope of TVK m.31, "false statement" or "concealment of a material fact" constitutes an accusation directed against the individual. In withdrawals within the scope of TVK m.40, however, it must be demonstrated which legal condition was not fulfilled as of the date the citizenship decision was rendered. Regardless of the heading used by the administration, a concrete person–concrete document–concrete legal condition connection must be established in the petition.

Which Documents Should Be Prepared in a Lawsuit for Revocation or Withdrawal of Citizenship?

The collection of documents must not be conducted by simply "adding everything to the file." It must be explained which allegation of the administration each document responds to, and a chronological chain of evidence must be established.

1. Decision and Service of Process File

  • The initial decision or record regarding the acquisition of citizenship,
  • The full text and annexes of the revocation or withdrawal decision,
  • The Official Gazette copy, service envelope, return receipt, and electronic notification records,
  • Documents showing the change in the population registry,
  • Applications made to the administration and responses thereto.

2. Investment and Title Deed File

  • Real estate investment determination or conformity certificate and, if applicable, the cancellation notice,
  • Title deed official deed or notary public sales promise agreement,
  • Current and historical title deed record of the immovable,
  • Valuation report, value determination document, and relevant institutional correspondence,
  • Commitment not to sell for three years or title deed annotation,
  • Tax and fee receipts regarding the immovable.

Additionally, regarding the legal function of the three-year commitment and the removal of the annotation Turkish citizenship cannot be sold for three years annotation you can check our guide.

3. Payment and Money Transfer File

  • The original bank receipts or bank-verified copies,
  • Detailed transaction histories of the sender and recipient accounts,
  • If the transfer was made from abroad, the SWIFT message and correspondent bank records,
  • Foreign exchange purchase certificate and exchange rate/date calculation,
  • Records explaining which real estate property the sale price was paid for,
  • If the payment was made from a third-party account, its legal and economic explanation.

4. Personal Tie and Good Faith File

  • Application forms and signed statements,
  • Records of the interpreter, attorney, bank, and intermediary institution used,
  • Correspondence showing what information the person accessed and when,
  • Records regarding who prepared the attributed document,
  • If any, complaint, non-prosecution, acquittal, or investigation documents.

5. Irreparable Harm File

  • Family and civil registry records,
  • Children's school and exam documents,
  • Employment, corporate, tax, and commercial contract records,
  • Health and medical treatment documents,
  • Travel obligations and passport procedures,
  • Documents demonstrating residence and lifestyle arrangements in Turkey.

Which Legal Questions Must Be Addressed in the Petition?

An effective statement of claim makes the discrepancy between the administrative action and the evidence visible, rather than merely listing the legislation consecutively. Based on the specific circumstances of the case, the following questions must be answered:

  1. Is the authority that enacted the administrative action competent, and was the correct legal basis utilized?
  2. Has the justification for the annulment or revocation decision been communicated to the individual?
  3. Did the facts relied upon by the administration exist as of the application date?
  4. If false statements or concealment are alleged, has it been explained which statement is contrary to the truth and for what reason?
  5. If a lack of legal conditions is alleged, which condition is lacking, and by what document is this deficiency proven?
  6. Is there a direct causal link between the findings in the collective report and the plaintiff?
  7. Has the revocation of the certificate of conformity become final, has it been served, and has it also been subject to litigation?
  8. If there is a criminal investigation or prosecution, what stage is it in; if not, has this circumstance been demonstrated by official records?
  9. Upon which decision is the citizenship status of the spouse and children based, and how does the administrative act affect them?
  10. What concrete and difficult-to-remedy consequences does the implementation of the act entail today?

Article 66 of the Constitution, stipulates that judicial review cannot be precluded against decisions and actions regarding the revocation of citizenship. Furthermore, pursuant to Article 125 of the Constitution, judicial review is available against all kinds of acts and actions of the administration. These guarantees do not mean that the administrative act will necessarily be annulled; however, they ensure that the reasoning and evidence of the administration can be reviewed before an independent court.

Common Mistakes to Avoid for Individuals Whose Citizenship Has Been Revoked

  • Acting solely based on the civil registry without reviewing the reasoning of the decision: The final registry entry alone does not demonstrate the legal and factual grounds of the administrative act.
  • Assuming that submitting a petition to the administration always stays the statute of limitations for filing a lawsuit: Time limits cannot be calculated without examining the nature and date of the application.
  • Assuming the lawsuit will automatically stay the proceedings: A stay of execution must be separately requested, and two statutory conditions must be substantiated.
  • Submitting only the title deed: Real estate investments are evaluated together with valuation, payment, banking, foreign exchange, and conformity certificates.
  • Making a single and ambiguous claim on behalf of all family members: The transaction, service of process, representation, and claim status of each individual must be clearly stated.
  • Responding to the allegations in the collective report with a general denial: The claimant's real estate and payment chain must be matched one by one.
  • Treating the revocation of the conformity certificate as negligible: This action may constitute the primary legal basis for the revocation of citizenship and may also need to be challenged in a separate lawsuit.
  • Treating a criminal investigation and an administrative proceeding as the same: A notification, investigation, prosecution, and final conviction are distinct legal stages.
  • Submitting incomplete or contradictory documents without explanation: Discrepancies in dates, amounts, parties, or descriptions must be resolved or legally justified.

Practical Checklist for the First 48 Hours and the First Week

Time Action to be taken Purpose

Without delay Check simultaneous risks regarding residence, employment, travel, and family status. Managing other status issues while the citizenship lawsuit is pending.

The Core Professional Approach Reflected by This Interim Decision

Legal work in a citizenship revocation or withdrawal lawsuit is not limited to the preparation of a single petition. The chain of administrative actions extending from the initial citizenship application to the subject decision of the lawsuit must be re-established; records from different institutions must be cross-referenced; and missing, contradictory, or non-personalized findings must be clearly demonstrated.

The Council of State (Danıştay) interim decision in the file handled by our office also demonstrates the importance of this method: While the court requests the decisions on the acquisition and revocation of citizenship on the one hand, it investigates land registry, bank, foreign exchange, criminal investigation, judicial assistance, and security records on the other. This does not guarantee any outcome; rather, it reveals the multi-institutional and document-intensive nature of citizenship disputes.

Frequently Asked Questions Regarding the Revocation of Turkish Citizenship

If my Turkish citizenship has been revoked, is it sufficient to reapply?

Generally no. A new application does not automatically invalidate the previous revocation or withdrawal procedure. First, the legal basis of the current decision, the litigation period, and the judicial remedy must be evaluated.

What is the statutory deadline for filing a lawsuit against a citizenship revocation decision?

Unless a specific period is prescribed, the general limitation period is 60 days. However, the starting date must be determined specifically for the case based on the method of notification, publication, or awareness. Conducting a deadline review as soon as the decision is seen is the safest approach.

Does filing a lawsuit automatically stay the enforcement of the citizenship revocation decision?

No. Filing an annulment action does not automatically stay the execution of the administrative act. A stay of execution must be requested by substantiating the conditions of clear unlawfulness and damages that are difficult or impossible to compensate.

Where is the lawsuit filed if citizenship is withdrawn by a Presidential Decree?

In lawsuits filed against Presidential decrees, the Council of State (Danıştay) may act as a court of first instance pursuant to Article 24 of the Council of State Law No. 2575. Nevertheless, each contested act and decision-making authority must be examined individually.

Are the revocation of the certificate of conformity and the withdrawal of citizenship the same administrative act?

No. The cancellation of a conformity certificate is a distinct administrative act concerning the determination of the investment that formed the basis of the citizenship decision. On the other hand, the revocation or withdrawal of citizenship targets the citizenship status itself. The link between the two acts and whether a lawsuit must be filed against each of them must be evaluated on a case-by-case basis.

If there is no criminal case against me, will the citizenship withdrawal procedure be definitively cancelled?

No. The absence of a criminal investigation or prosecution may be a significant factor; however, the administrative judiciary examines all legal and factual grounds of the act. Criminal liability and the lawfulness of the administrative act are not subject to the same evaluation.

Is the presence of my name on a collective list sufficient for the withdrawal of citizenship?

A collective list may serve as one of the bases for the administrative investigation. However, the concrete link between the individual, the investment, the payment, the document, and the alleged unlawfulness must be demonstrated in a manner amenable to judicial review.

Should the spouse and children also file a lawsuit?

This depends on whom the decision covers, how the spouse and children acquired citizenship, their ages, and whether a notification was served upon them. Standing and procedural requests must be established separately for each family member.

Can I not file a lawsuit if the decision has not been served on me?

No, the absence of service (tebliğ) alone does not eliminate the right to file a lawsuit. However, the date on which the statutory period begins and how the administrative act became known must be carefully evaluated. In its interim decision, the Council of State (Danıştay) specifically inquired whether the decision had been served and requested the submission of any return receipts.

Does the issuance of an interim decision by the Council of State mean that the case has been won?

No. An interim decision aims for the court to gather missing information and documents it deems necessary to render a decision. It does not constitute a positive or negative final outcome regarding a stay of execution or the merits of the case.

Conclusion: Protect Deadlines, Review the Procedural Chain and Evidence Together

For an individual whose Turkish citizenship has been revoked or whose citizenship decision has been withdrawn, the greatest risk is not merely the legal consequence of the decision; overlooking the statute of limitations, the competent court, the representation of family members, and the underlying administrative procedures may also lead to a loss of rights. The first step is to obtain the full text of the decision and notification records; the second step is to organize investment, payment, and application documents into a chronological chain; and the third step is to establish an annulment action and a request for a stay of execution based on concrete evidence.

The interim decision of the 10th Chamber of the Council of State (Danıştay) that we reviewed demonstrates that the court does not limit the dispute regarding the revocation of citizenship to a single institutional report; rather, it investigates a broad scope of evidence ranging from citizenship acquisition and revocation decisions to title deed and bank records, criminal and judicial assistance data, and security evaluations. Each of these evidentiary areas must be evaluated in connection with the specific individual's file.
