Istanbul Criminal Lawyer and Client Relationship
An Istanbul criminal defense attorney must first possess sufficient knowledge about the criminal file they will undertake before providing information to the detained person or their relatives. Most of the time, the detainee or their relatives convey the incident subject to the investigation unilaterally and only to the extent of what they know. Frequently, information is provided before the police or gendarmerie report and incident report—specifically how the incident occurred, the manner in which any notice was given if applicable, and other evidence in the file—are confirmed by the suspect or defendant.
Providing information to the suspect or their relatives regarding the outcome of the case without possessing sufficient knowledge may not only be erroneous but can also frequently lead to communication problems between the client and the criminal defense attorney. In addition, the information and advice provided to the client or their relatives by a heavy penal court attorney must be consistent and realistic. Istanbul heavy penal court attorneys must inform their clients realistically regarding the existing file, taking into account potential issues that may be encountered in practice.
Providing information about possible and probable negative scenarios will facilitate the resolution of problems that may be encountered in the future. Positive scenarios regarding the criminal file that have a low probability of occurring should be explained as such to the detained client or their relatives.
Criminal defense attorneys frequently encounter requests from detained individuals or their relatives that do not align with material truth. If the client or prospective client is detained, the relatives of the detainee may very frequently request prison visits simply for the purpose of conversing with them.
However, it must be explained to the client's relative before commencing legal services that this situation is neither an action directed toward the benefit of the criminal file nor compatible with the practice of law. The defendant or suspect client held in prison should be visited for the purpose of keeping them informed about developments regarding their file and the evidence contained therein.
Prior to the hearing, consultations and defense preparations should be conducted in prison in order to prepare the client for the defense to be presented at the hearing. However, apart from these explained professional activities, visiting the suspect or defendant in prison for personal purposes such as casual conversation is incompatible with the legal profession and may prevent the attorney from allocating their labor and efforts more productively to that case. This is a matter to which the relatives of detained or convicted individuals must pay attention.
