The crime of migrant smuggling, with the aim of directly or indirectly obtaining financial benefit, is the unauthorized entry of a foreign national into Turkey, facilitating their stay in the country, or enabling a Turkish citizen or foreign national to leave the country through illegal means. Pursuant to Article 79 of the Turkish Penal Code , the primary sanction is imprisonment from 5 to 8 years and a judicial fine from 1,000 to 10,000 days.

However, the mere presence of the foreign national in a vehicle, residence, or workplace is not sufficient alone for a conviction. Whether the defendant was aware of the unlawful status of the foreign national, which alternative act they participated in, and specifically with the aim of obtaining financial gain whether or not they acted must be demonstrated through lawful evidence. The absence of bank transactions does not automatically result in an acquittal, nor does the presence of a foreign national in the vehicle automatically result in a conviction. The assessment is made based on all the evidence in the case file.

This article has been prepared to provide general legal information. Each investigation and lawsuit must be examined separately, taking into account the timing of the incident, the evidence, the roles of the individuals, and current legislation.

What is the Crime of Migrant Smuggling?

Article 79 of the TCK penalizes three distinct acts committed for the purpose of financial gain. These are: illegally bringing a foreigner into the country, enabling a foreigner to stay in the country illegally, and enabling a Turkish citizen or a foreigner to exit the country illegally. Since the realization of any one of these is sufficient, the provision is a crime with alternative conduct .

The article is located in the "International Crimes" section of the TCK. In interpreting this provision, alongside the statutory text, the United Nations Protocol against the Smuggling of Migrants is also of significance. The Protocol establishes the framework based on facilitating the illegal entry of a person into a State of which the person is not a national or a permanent resident, in order to obtain, directly or indirectly, a financial or other material benefit.

Three Alternative Conducts Within the Scope of TCK Article 79

  • Bringing a foreigner into the country: Examples of this include facilitating a person's entry into Turkey from a location other than a border gate, using forged documents or documents belonging to another person, or evading border control.
  • Enabling a foreigner to stay in the country: Providing facilities for sheltering, hiding, or evading supervision, knowingly and with the intent of obtaining material gain, can be debated within this scope. Not every rental or assistance act automatically constitutes a crime.
  • Facilitating departure from the country: It is the facilitation of taking a Turkish citizen or a foreigner to another country, either outside of border control or by using forged documents.

Although the concept of "facilitating" is broad, it is not limitless. For transportation, accommodation, forged documents, liaison, or route support to be evaluated within the scope of the crime, the connection of the act with illegal entry, stay, or exit, and the perpetrator's specific intent must be substantiated.

What Are the Elements of the Crime of Migrant Smuggling?

Who Can Be a Perpetrator?

Migrant smuggling is not a crime requiring a specific status (özgü suç); anyone meeting the necessary conditions can be a perpetrator. As for the driver, boat owner, organizer, person providing residence, or person establishing liaison, not only their title, the concrete act and the joint intent to commit a crime are investigated. A person's presence at the scene of the incident or being the owner of the vehicle is not sufficient by itself for perpetrator status.

Who is the Subject Matter of the Crime?

In acts of smuggling into the country and facilitating staying in the country, the subject matter of the crime is a foreigner. As for facilitating departure from the country, the person can be either a Turkish citizen or a foreigner. The migrant's consent to the transit does not solely prevent the formation of TCK m.79 (Turkish Penal Code art. 79).

Execution of the Act through Illegal Means

Meeting the ordinary transportation or accommodation needs of a person who has a valid passport, visa, or right of residence is, as a rule, not within the scope of TCK m.79. On the other hand, facts such as forged documents, hidden compartments, routes outside the border gate, evading identity checks, or concealing unlawful stay gain importance in evaluating "illegal means".

Mental Element: Knowledge, Intent, and the Purpose of Material Gain

The crime cannot be committed by negligence. The perpetrator must both know and desire the relevant illegal entry, stay, or exit, and must act with the purpose of obtaining direct or indirect material benefit. When this specific intent is not proven, a conviction cannot be established pursuant to Article 79 of the TCK based solely on the act of general assistance.

It is not a requirement that the material benefit be physically received. The promise of payment, coverage of fuel expenses, forgiveness of a debt, commission, gratuitous labor, or avoidance of economic obligations may also be considered direct or indirect benefits depending on the circumstances of the case. Conversely, the mere claim of kinship, friendship, or humanitarian aid is not accepted on its own; the claim is tested together with facts reflected in the external world.

How is the Purpose of Financial Benefit Proved?

In criminal proceedings, the judgment must be based on evidence debated at the hearing and obtained in accordance with the law. Pursuant to Article 217 of the Code of Criminal Procedure, the judge renders their decision based on the free evaluation of evidence. Therefore, the objective of material benefit can be proven not only through a bank receipt, but also through complementary evidence such as migrant statements, messages, call logs, location data, route, promise of payment, and the manner in which the incident occurred.

Evidence or Fact What can it demonstrate? What does it fail to demonstrate on its own?
Bank transfer, cash, payment message Receipt or promise of material benefit That the payment was definitively in exchange for a crime
Telephone calls and messages Contact with organizers, route and fee agreement Complicity without a determined content
HTS (historical traffic search) and location data The harmony of communication and movement between individuals The content of the conversation or specific intent
Secret compartment, curtain, numerous life jackets That the transportation was consciously planned The role of each defendant and the purpose of gain
Migrant or witness statement Fee, contact, meeting and route Definite establishment without resolving contradictions
Excessive or unusual transportation fee The possibility of economic benefit connected to the crime Specific intent without investigating the nature of the fee

Important: The absence of bank records in the file does not prevent the purpose of material gain from being proven by other evidence. Likewise, the presence of money cannot be deemed sufficient without establishing a connection between the money and the crime. The principle of in dubio pro reo (the defendant benefits from the doubt) does not mean that evidence is not examined at all; rather, it means that reasonable doubt that cannot be resolved upon examination shall not be used against the defendant.

When is the Crime of Migrant Smuggling Completed?

The crime is completed upon the realization of any of the alternative conduct. However, Article 79/1 of the TCK contains a special provision regarding attempt: Even if the crime has remained at the attempt stage, punishment shall be imposed as if it were completed. Therefore, the apprehension of migrants in the vehicle before crossing the border does not warrant a reduction of the sentence due to attempt, provided the conditions are met.

Nevertheless, preparatory acts must be distinguished from executive acts. A yet undetermined thought, general discussions, or behaviors indicating that the execution of the crime has not directly commenced cannot automatically be accepted as an attempt. Whether the perpetrator has directly commenced the execution of the crime through suitable acts is determined based on the specific circumstances of the case.

What is the Penalty for the Crime of Migrant Smuggling?

Situation Legal Basis Conclusion
Basic offense TCK m.79/1 5 to 8 years imprisonment and 1,000 to 10,000 days of judicial fines
Endangerment to life or degrading treatment TCK m.79/2 The specified sentence shall be increased from one-half to two-thirds
Commission jointly by more than one person TCK m.79/3 The specified sentence shall be increased by up to one-half
Commission within the scope of the activities of an organization TCK m.79/3 The specified sentence shall be increased from one-half up to fold
Commission within the scope of the activities of a legal entity TCK Art. 79/4 and Art. 60 Security measures specific to legal entities may come into question

Mortal Danger and Degrading Treatment

Transporting people in unventilated, closed compartments, well above carrying capacity, for a long time without water, or on a boat that jeopardizes life safety may be evaluated within the scope of TCK Art. 79/2. An abstract risk statement should not be sufficient for an enhancement; transportation conditions, duration, number of persons, vehicle characteristics, and concrete danger must be stated in the grounds.

Joint Perpetration and Organized Perpetration Are Not the Same Thing

The acting together of more than one person does not demonstrate the existence of a criminal organization in every case. In the evaluation of an organization, conditions within the scope of TCK Art. 220, such as continuity, hierarchy, a structure capable of committing target crimes, and the number of members, are additionally examined. Establishing a one-time communication with the organizer does not solely result in organization membership.

Seizure of Vehicles and Confiscation in Migrant Smuggling

In practice, the seizure of an automobile, minibus, truck, boat, or another vehicle during the investigation is common. However, seizure and confiscation are not the same procedure. Seizure is a provisional protective measure aimed at protecting evidence or a confiscation decision that may be rendered in the future. Confiscation, on the other hand, is a security measure that results in the transfer of ownership of the property to the state by a final judgment when the conditions are met.

Criterion Seizure Confiscation
Legal nature Interim protective measure Security measure
Stage During the investigation or prosecution As a rule, together with the judgment
Consequence of ownership Does not automatically terminate ownership Transfers ownership to the state upon finalization
Substantive Examination Suspicion, necessity, and proportionality Conditions under TCK m.54, good faith, and proportionality

Can a Vehicle Belonging to a Bona Fide Third Party Be Confiscated?

Pursuant to TCK m.54, in the confiscation of property used in an intentional crime, whether the property belongs to a bona fide third party is crucial. If it cannot be proven that the vehicle owner knew about, permitted, or participated in the crime, transferring ownership to the state solely because the vehicle was used in the crime is not possible. The owner or right-holder must be heard; the lease agreement, the delivery conditions of the vehicle, the relationship between the parties, and prior uses must be investigated.

In the Constitutional Court's evaluation regarding the confiscation of vehicles belonging to third parties, emphasizing that a connection must be established between the owner and the crime, and that the interference with the right to property must be proportionate. This review, is connected to the right to property guaranteed under Article 35 of the Constitution. güvence altına alınan mülkiyet hakkıyla bağlantılıdır.

Why Is Proportionality Important?

Pursuant to TCK m.54/3, if it is understood that the confiscation of property would yield consequences more severe than the committed offense and would therefore be contrary to equity, confiscation may not be ordered. The value of the vehicle, its function in the crime, whether it was specially prepared, the continuity of its use, and the conduct of the owner are considered together. Establishing a mechanical proportion solely based on the vehicle value or the number of transported persons is insufficient.

Grounds for Acquittal in Migrant Smuggling Trials

An acquittal does not arise from repeating the same defense sentence in every file, but by demonstrating through the case file evidence which element of the accusation could not be proven and why. criminal investigation and prosecution while preparing a defense, the following headings in particular must be examined separately.

1. Failure to Prove the Purpose of Obtaining Financial Benefit

It must be proven beyond any doubt that the accused acted with the aim of direct or indirect financial gain. In the absence of discussions regarding payment, payments, promises, economic advantages, or other supporting facts, proving the specific intent may become debatable. However, the absence of a payment document is not solely a ground for acquittal; the purpose may also be determined through circumstantial evidence.

2. Lack of Knowledge Regarding the Unlawful Status of the Foreign National

It is not the same thing for a driver, homeowner, or employer to know that a person is a foreign national and to know that their status in the country is unlawful. Knowledge and intent are evaluated through the normality of the journey, payment, route, concealment of individuals, intermediary connections, and the consistency of the statements made by the accused. Commercial transportation activity neither gives rise to liability on its own nor provides absolute immunity.

3. Failure to Prove the Defendant's Participation in the Alternative Act

The mere presence of a contact in a phone book, vehicle ownership, or being at the crime scene does not in itself prove that illegal entry, stay, or exit was facilitated. Individualization must be made regarding each defendant's active contribution, joint control, or status as an accomplice.

4. Typicity Debate Regarding Return to One's Own Country

In certain decisions of the 4th Criminal Chamber of the Court of Cassation examined below, it has been accepted that transporting a foreigner to their country of citizenship does not constitute the subject matter of Article 79 of the TCK. In this approach, under Article 3 of Protocol No. 4 to the ECHR, the right of an individual to enter their own country and the international definition of migrant smuggling have been taken into consideration.

This conclusion cannot be automatically applied to every border crossing. The citizenship of the transported person, the destination country, the route, the aspect of departure from Turkey regarding the act, the date of the crime, and whether the decision corresponds to the specific circumstances of the case must be examined.

5. Unlawful Evidence or Incomplete Investigation

If the statutory conditions for a search, seizure, or digital examination are not met, the reliance of the judgment on the obtained data may be subject to appeal. However, the finding that a piece of evidence is unlawful does not automatically mean acquittal; whether the remaining lawful evidence proves the charges is evaluated separately. Furthermore, failure to resolve significant contradictions between migrants' statements, translation issues, or deficiencies in identification procedures may affect the reviewability of the judgment.

Court of Cassation Rulings on the Crime of Migrant Smuggling

The following decisions jointly illustrate the prominent criteria in the evaluation of acquittal and conviction. Case citations Supreme Court Decision Search can be searched by docket and decision numbers on the screen. The reference to a decision as a "precedent" does not mean that the same outcome will be reached in every case; the facts and evidence must be compared.

Three Key Conclusions Derived from Court of Cassation Precedents

  1. Evaluation is based on an evidentiary pattern rather than a single piece of evidence. The promise of payment, route, concealment method, and communication records, when considered together, may indicate intent.
  2. The liability of each individual is evaluated on a case-by-case basis. The legal status of the driver, the vehicle owner, the organizer, and the accommodation provider are not identical.
  3. Confiscation is not an automatic accessory to a conviction. Separate grounds must be established regarding the owner's good faith and proportionality.

The Difference Between Migrant Smuggling and Human Trafficking

Migrant smuggling and human trafficking, as regulated under Article 80 of the TCK, are distinct offenses. This distinction is based not only on the existence of a border crossing, but also on the perpetrator's purpose, the victim's will, and the relationship of exploitation.

Criterion Migrant smuggling Human trafficking
The primary purpose Facilitating illegal entry, stay, or exit in exchange for financial benefit Exploitation purposes such as forced labor, servitude, prostitution, slavery, or organ removal
The individual's will In most cases, there is consent to the transit Coercion, threats, pressure, deception, or taking advantage of vulnerability vitiates consent
Crossing borders It is of central importance in the entry or exit acts set forth by law It may also be committed within the country
The course of the relationship It is generally focused on facilitating arrival at the destination or ensuring continued stay The exploitation relationship may exhibit continuity

In respect of victims of human trafficking, alongside criminal investigation, special protection mechanisms and victim of human trafficking residence permit may also come into question.

Investigation, Detention, and Trial Procedure

Is the Investigation Subject to a Complaint?

The crime of migrant smuggling is not subject to a complaint; it is investigated ex officio by the public prosecutor's office. Withdrawal of a complaint does not result in the dismissal of the case. The crime is also not within the scope of conciliation and preliminary payment.

Which Court Has Jurisdiction?

Regarding the basic form, the competent court is, as a rule, the criminal court of first instance. Pursuant to the jurisdictional provisions of Law No. 5235, qualified circumstances requiring an increase in sentence are not solely taken into account when determining jurisdiction. However, the presence of a separate crime that must be tried together due to connection and falls within the jurisdiction of the heavy penal court may affect the jurisdictional assessment.

Is Detention Automatic?

It is among the catalog crimes enumerated in Article 79 of the TCK and Article 100/3 of the CMK. However, this does not mean automatic detention Strong suspicion of a crime based on concrete evidence, grounds for detention such as flight risk or tampering with evidence, as well as the necessity and proportionality of the measure must be evaluated separately. The reasons why judicial control would be inadequate must also be justified.

What is the Statute of Limitations Period?

Taking into account the statutory upper limit of the basic crime, the ordinary statute of limitations for prosecution is, as a rule, 15 years. However, proceedings that interrupt or suspend the statute of limitations, the date of the crime, the age of the defendant, and qualified circumstances may alter the concrete calculation. Therefore, one should not conclude that the case file is time-barred merely by looking at the calendar difference.

HAGB, Suspension of Sentence, and Conversion of Imprisonment to a Judicial Fine

Since the lower bound of the base sentence is 5 years, even if standard reductions are applied with respect to a principal adult perpetrator, the resulting sentence in most cases cannot be reduced to the threshold for HAGB or suspension. Conversion to alternative sanctions provided for prison sentences of one year or less also generally cannot be applied in the base offense. However, since minority age, aiding and abetting, and other statutory reduction grounds, as well as the individual's status in the case, may alter the final sentence calculation, a definitive assessment must be made based on the adjudicated sentence.

How is Sentence Execution Calculated?

It is not accurate to answer the question "How many years will be served in prison?" by looking solely at the sentencing range in Article 79 of the TCK. The finalized sentence, date of the offense, recidivism, time spent in pre-trial detention, conditional release, and probation provisions are evaluated together. In the current calculation Execution Law No. 5275 shall be taken as the basis.

Administrative Consequences for Foreign Nationals

Criminal investigation and the administrative process concerning the foreigner are distinct from one another. Regarding the foreigner, deportation decision, administrative detention and removal center processes, restriction code or entry ban to Turkey may arise. These proceedings Law No. 6458 on Foreigners and International Protection are additionally examined within the scope of.

If there is an allegation of the risk of persecution, torture, or serious harm in the event of the individual's deportation to their country international protection application and a separate assessment must be made regarding the prohibition of refoulement. The status of "migrant" in the criminal file does not automatically eliminate the need for protection.

What Should Be Done First in a Migrant Smuggling Investigation?

  1. Learn the allegations in the file prior to giving a statement. The suspect has the right to benefit from the assistance of legal counsel and the right to remain silent. An interpreter must be provided for individuals who do not speak Turkish.
  2. Preserve exculpatory digital data. Regular taxi calls, navigation history, reservations, invoices, car rental records, and correspondence may subsequently disappear.
  3. Substantiate the claim of payment. It must be investigated by whom, for what purpose, and when the fee was promised, as well as how it differs from the standard transportation fare.
  4. Differentiate the role of each defendant. The vehicle owner, driver, passenger, intermediary, and organizer are not in the same legal position.
  5. Obtain the seizure report and vehicle documents. If the vehicle belongs to a third party, the owner's knowledge, the rental relationship, and the purpose of use must be documented without delay.
  6. Identify discrepancies between the statement and the translation. If there are material discrepancies between the migrants' initial statement, the identification procedure, and the hearing testimony, resolution of these discrepancies must be requested.

In files involving allegations of residential leasing, independently of the elements of the offense, Law No. 1774 on Identity Notification obligations within the scope of may also come into question. The violation of identity notification and the specific intent under TCK m.79 do not constitute the same legal issue.

Frequently Asked Questions About the Crime of Migrant Smuggling

What is the prison sentence for the crime of migrant smuggling?

The baseline sentence is imprisonment from 5 to 8 years and a judicial fine from 1,000 to 10,000 days. Life endangerment, degrading treatment, commission by multiple persons together, or organized crime activity may lead to an enhancement of the sentence.

Is obtaining a material benefit required for the crime of migrant smuggling?

No. The law does not require the actual acquisition of financial gain, but rather acting with the objective of obtaining such gain. A promise of payment may also suffice; however, the intent must be proven with concrete evidence.

Is the apprehension of irregular migrants in my vehicle sufficient on its own for a conviction?

No. It must be proven that the unlawful status of the foreigners was known, that a conscious contribution was made to the transport, and that there was a purpose of financial gain. Nonetheless, the route, method of concealment, payment, and communication records taken together may serve as the basis for a conviction.

Is it a crime to pick up a hitchhiking foreigner in a vehicle?

Merely taking a foreigner into a vehicle free of charge and for humanitarian purposes is not sufficient for TCK m.79. However, if there is other evidence demonstrating that the individual's status was known or that a planned transport was conducted in exchange for a fee, the incident may be evaluated differently.

Is it a crime to rent a house to a foreigner when I do not know they are undocumented?

Without proving the specific intent of knowledge and financial gain, TCK m.79 is not established. There is a distinction between an ordinary rental relationship and knowingly concealing an unlawful stay. On the other hand, the breach of the identity notification obligation may entail separate consequences.

Is employing an irregular migrant considered migrant smuggling in every case?

Not in every case. The Court of Cassation has, in certain instances, considered the evasion of insurance, tax, and employment obligations as indirect financial gain. However, the employer's knowledge, the employee's status, the economic advantage, and the act of facilitating the stay in the country must be demonstrated in the specific case file.

Is a sentence reduction applied if the crime remains at the attempt stage?

Due to the special provision in TCK m.79, even if the offense remains at the attempt stage, it is punished as if completed. Nevertheless, it must be additionally examined whether execution acts were directly commenced.

Is the vehicle used in the crime necessarily confiscated?

No. If the vehicle belongs to a bona fide third party, or if confiscation would yield disproportionately severe consequences contrary to equity given the committed offense, the conditions for confiscation may not be met. The owner must be heard and their connection to the offense investigated.

Is pre-trial detention mandatory for the crime of migrant smuggling?

No. Even if the offense is included in the catalog crimes, strong suspicion of guilt, concrete grounds for detention, necessity, and proportionality are required. The decision must explain why judicial control measures are insufficient.

In which court is the crime of migrant smuggling tried?

As a rule, the court of first instance having jurisdiction over the primary offense is the Criminal Court of First Instance (asliye ceza mahkemesi). Circumstances such as the joint trial of a connected separate offense falling under the jurisdiction of the High Criminal Court (ağır ceza mahkemesi) may alter the jurisdictional assessment.

Can a prison sentence be commuted to a judicial fine?

As a rule, it is not possible to commute a prison sentence imposed due to the 5-year lower limit of the primary offense into a judicial fine as a short-term prison sentence. The law additionally provides for a judicial fine based on daily rates alongside imprisonment.

Is it a crime to transport a foreigner who wishes to return to their own country?

In certain decisions of the 4th Criminal Chamber of the Court of Cassation (Yargıtay), the transport of a foreign national to their country of citizenship has been deemed outside the scope of Article 79 of the TCK. However, this conclusion cannot be reached automatically without examining citizenship, the destination country, the route, and the nature of the act.

Conclusion

In the offense of migrant smuggling, the legal evaluation cannot be reduced merely to the presence of foreign nationals in the vehicle or apprehension at the border line. Alternative actions, the individual's knowledge of the unlawful status, the objective of material gain, the defendant's individual contribution, and the lawfulness of the evidence must be examined together. Regarding the vehicle, seizure and confiscation must be distinguished; the property rights of a bona fide third party and proportionality must be observed.
