Criminal Law

What is the Crime of Sterilization (TCK Art. 101)?

The crime of sterilization, of a person the capacity to have children / reproductive capability through medical intervention being permanently eliminated is the realization of this act outside the conditions required by law.

TCK Article 101 specifically protects sterilization from two main perspectives:

  • In the absence of consent: The individual's bodily integrity is severely violated.
  • If not performed by an authorized person: Health security and the lawfulness of the medical intervention are compromised.

Conditions of the Crime of Sterilization Pursuant to TCK Article 101

1) There Must Be an Intervention Constituting "Sterilization"

For TCK Article 101 to apply, the act performed must be of a nature that deprives the person of reproductive capacity . Such interventions are generally medical procedures and in most cases require expertise, technical conditions, and recording/monitoring.

2) The Element of Consent (Informed Consent)

The statutory text explicitly uses the concept of "consent". In practice, consentis not merely saying "yes"; it requires the individual to fully understand:

  • the nature of the intervention,
  • its consequences (including permanence),
  • its alternatives,
  • its risks

making a decision by understanding. ECHR case law also in sterilization informed consent reinforces the emphasis (V.C. v. Slovakia judgment).

3) Condition of Being Performed by an Authorized Person

The focus of TCK Article 101/2 is as follows: Even if consent exists, sterilization by an unauthorized person constitutes a crime.

The main justification for this approach is: Sterilization is a severe and irreversible intervention in terms of its consequences; therefore, only legally and professionally authorized must be performed by persons under health conditions compliant with the legislation.

Penalty for the Crime of Sterilization Without Consent

What is the prison sentence for sterilization without consent?

According to TCK Article 101/1:

  • Sterilization without consent the person who performs imprisonment from 3 to 6 years shall be punished.

Is the penalty increased if performed by an unauthorized person?

Yes. According to the same paragraph:

  • Act not authorized to perform the sterilization procedure if performed by a person,
  • penalty to be imposed it shall be increased by one-third.

Sterilization Performed by an Unauthorized Person Even with Consent

Why is it a crime if there is consent?

The rationale behind TCK Article 101/2 is as follows: Even if the individual consents, if such a major medical intervention as sterilization is unauthorized persons are performed by:

  • patient safety,
  • medical standards,
  • records/traceability,
  • capacity to intervene in complications

it creates serious risks in areas such as these. Therefore, the law does not consider the act lawful merely because consent exists.

What is the penalty under TCK Article 101/2?

  • Imprisonment from 1 to 3 years .

When Can Sterilization Be Legally Performed?

In addition to the penal judgment, Article 4 of Law No. 2827 states:

  • Sterilization surgery, if there is no medical contraindication, upon the request of an adult individual is conducted.

This framework highlights two important points in practice:

  1. In minors and/or in cases where legal capacity is disputed, the issue of consent becomes more complex.
  2. Obtaining “request” and “consent” in due form (informed consent, documentation, record-keeping, physician evaluation) is of critical importance.

Furthermore, the same article stipulates that in certain cases of medical necessity, intervention regarding "castration" may be performed without seeking consent; however, this is a highly exceptional situation requiring medical necessity (Law No. 2827, Art. 4).

Key Practical Considerations in the Crime of Sterilization

Is "consent" truly valid?

Some of the controversial issues in practice include:

  • Whether consent was obtained under duress
  • Whether the individual was sufficiently informed while giving consent
  • Whether the permanent outcome of the sterilization was understood
  • The content of medical records and informed consent forms
