A person who receives such information would be well advised to apply directly to the relevant police headquarters rather than being content with statements made over the telephone, and to ascertain whether the document was indeed issued in their name.<\/p>\n<p>Information such as the person's identity, the authority summoning them, the reason for the summons, the investigation number if any, the date of the statement, or the designated official unit for communication must be verified on the official invitation document. How the service of process took place, the content of the document, and whether a deadline is specified in the summons are also important. In the event that the document is not understood due to a foreign language barrier, the need for translation and legal assistance must be met without delay.<\/p>\n<p><strong>Practical tip:<\/strong> Apply with your identity document, passport, and the invitation letter sent to you; keep a copy of every document you submit or receive. The correct approach is to preserve existing documents without alteration, establish a chronological order of events, and honestly evaluate actions that are difficult to explain with an attorney.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Polis_Ifadesinde_Hangi_Haklariniz_Bulunur\"><\/span>What Are Your Rights During a Police Interrogation?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Article 147 of the Code of Criminal Procedure (CMK) numbered 5271 sets forth the fundamental principles to be observed while taking a suspect's statement. Notification of the accusation directed against the person, explanation of the right to choose counsel, the presence of an attorney during the statement, reminding of the right to remain silent regarding the charged offense, and the right to request the collection of evidence in their favor are among the primary guarantees. <strong>Complying with an invitation to give a statement and being obligated to answer every question are not the same thing.<\/strong><\/p>\n<p>It is particularly important that a person who does not have adequate command of Turkish fully understands the content of the statement transcript. Under necessary conditions, the assistance of an interpreter should be requested, it must be checked whether the given answers are accurately recorded in the transcript, and the document must not be signed without being read or understood. This point is important for correctly understanding the legal consequences of an invitation to give a statement.<\/p>\n<p>Failing to appear to give a statement, disregarding the invitation letter, traveling abroad, or failing to report an address change to the competent authority may expose an individual to unexpected judicial proceedings. Nevertheless, situations such as a valid excuse, a summons sent to an incorrect address, service issues, or the individual being abroad must be evaluated separately in terms of documentation and procedure. The actual purchase of the real estate, meeting the applicable investment threshold at the relevant time, proper payment, valuation, title deed, and conformity documents are evaluated collectively. Citizenship through investment, <a href=\"https:\/\/batinyilmaz.av.tr\/en\/turkiyede-yatirim-yoluyla-vatandaslik\/\">acquisition of Turkish citizenship through real estate acquisition<\/a> falls within the exceptional citizenship regime detailed in our guide.<\/p>\n<p>For instance, if a high price is shown on the title deed but the parties have agreed that this price will not actually be paid, the apparent sale may have been substituted for a genuine investment capable of conferring citizenship. Similarly, it may be alleged that the purchase price was remitted back to the other party after the sale, or that hidden agreements existed demonstrating that the actual owner of the real estate did not change. However, <strong>The existence of these possibilities does not mean that collusion (muvazaa) has been established regarding a specific investor.<\/strong> The administration and judicial authorities must conduct their evaluations based on concrete actions and evidence.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Gayrimenkul_Satisinda_Muvazaa_Nedir_ve_Nasil_Arastirilir\"><\/span>What is Collusion in Real Estate Sales and How is It Investigated?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>In general terms, collusion (muvazaa) is the conscious discrepancy between the transaction declared by the parties to third parties and their true intent. Various forms of this may be observed in real estate sales: examples include arranging a title deed transaction as if a real sale took place when it did not, creating the impression that the purchase price was paid, or establishing a secret agreement that eliminates the true economic outcome of the sale.<\/p>\n<p>However, the fact that an actual piece of real estate has been transferred on the title deed does not, on its own, refute all claims; conversely, the fact that the sale price differs from the market value does not, by itself, prove collusion (muvazaa). Real estate sale prices can be influenced by location, construction stage, apartment features, delivery date, payment flexibility, currency fluctuations, and commercial terms in the contract. Relying on a single piece of data to the exclusion of all other documents during an examination is not sound.<\/p>\n<p>In an investigation, the originating and destination accounts of bank transfers, who bore the actual payment burden, who has possession of the real estate, the sale date on the title deed, and previous relationships between the owners may be considered collectively. Furthermore, the fact that buyers worked with the same sales company or representative does not automatically mean that a conspiracy exists among these individuals. It must also be demonstrated that the suspect had knowledge of a specific irregularity and through which conduct they participated in it.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Ekspertiz_Raporunun_Yuksek_Olmasi_Vatandasligin_Iptali_Icin_Yeterli_midir\"><\/span>Is an Overvalued Appraisal Report Sufficient for the Revocation of Citizenship?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>No. The fact that a valuation in an appraisal report turns out differently in a subsequent examination does not mean that citizenship will be revoked automatically. The date as of which the valuation was made, the comparables used, the actual physical condition of the real estate, the methodology by which the report was prepared, and the market conditions on that same day must be examined. A subsequently prepared report must take into account the economic conditions of the period when evaluating a transaction that occurred in the past. In particular, automatically comparing an investment made on an old date with today's price or today's investment threshold is misleading.<\/p>\n<p>Regarding the changes made in the real estate valuation process in 2026 <a href=\"https:\/\/batinyilmaz.av.tr\/en\/vatandaslik-gedas-zorunlulugu-kaldirildi\/\">the removal of the GEDA\u015e requirement in citizenship applications<\/a> our article can be reviewed separately. This regulation does not mean that every past transaction was irregular or that the new procedure will be applied in the same manner to all past transactions. The legislation in effect at the time of the transaction and today's audit procedure must be evaluated separately.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Satis_Bedelinin_Gercekten_Odendigi_Nasil_Ispatlanabilir\"><\/span>How Can It Be Proved That the Purchase Price Was Actually Paid?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>In a citizenship file, often one of the strongest pieces of evidence is bank records showing for what reason and how the funds passed from the buyer to the seller. However, the matter is not limited solely to the existence of a bank receipt. To whom the sending account belongs, what is written in the description section, which contract the payment is based on, whether the payment was refunded in whole or in part, and how conversions were made if different currencies were used are also significant.<\/p>\n<p>Sometimes the involvement of a family member, a company, or a third party in the payment process can be legally explained. In such cases, the origin and reality of this role must be demonstrated with documents. The buyer's financial means, loans, commercial income, savings, and international transfers may be subject to evaluation. What matters is not abstract explanations, but a coherent payment chain. While a break in this chain does not necessarily indicate that a crime was committed, it may constitute an issue that needs to be explained in the defense.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Ceza_Sorusturmasi_ile_Vatandasligin_Iptali_Ayni_Sey_midir\"><\/span>Are Criminal Investigation and Revocation of Citizenship the Same Thing?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>No. The fact that a criminal investigation is conducted against an individual by the Istanbul Chief Public Prosecutor's Office does not automatically terminate their Turkish citizenship. For citizenship status to be terminated, a separate action with a legal basis must be taken by the authorized administrative authority within the framework of the Turkish Citizenship Law No. 5901. This action is subject to judicial review. The evidence in the investigation may play a role in the administrative authority's evaluation; however, the administrative decision must have its own grounds and legal conditions.<\/p>\n<p>On one hand, it may be assessed that the elements of a crime are not established in the prosecutor's investigation; on the other hand, whether the investment condition objectively existed at the time the citizenship decision was rendered can be separately debated. The converse is also possible: while there may be no concrete and sufficient basis for the administrative action, another criminal allegation may be under investigation in the criminal case. Therefore, criminal defense and administrative citizenship defense must be conducted in a manner that does not contradict each other, yet based on separate legal standards.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"5901_Sayili_Kanunun_31_ve_40_Maddeleri_Neden_Onemli\"><\/span>Why are Articles 31 and 40 of Law No. 5901 Important?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>Article 31 of Law No. 5901<\/strong>, pertains to the revocation of a decision granting citizenship as a result of the concerned party's false statement or concealment of crucial matters that constituted the basis for the acquisition of citizenship. In this context, it must be debated which information was incorrect, in what respect it was attributed to the person, and how it affected the citizenship decision.<\/p>\n<p><strong>Article 40 of Law No. 5901<\/strong> , on the other hand, regulates the withdrawal of a decision regarding the acquisition or loss of citizenship if it is subsequently understood that it was issued without the legal conditions being met or was issued duplicatively. Therefore, although the terms \"revocation\" and \"withdrawal\" are used interchangeably in everyday language in the same incident, their legal bases and the facts that the administration must put forth are different.<\/p>\n<p>In particular, transactions such as the transfer of title deed on behalf of the investor, the preparation of a valuation report, and the issuance of a conformity certificate are influential documents in the formation of the citizenship decision. It must be concretized why these are deemed invalid or insufficient. The existence of allegations against the seller, project representative, intermediary, or valuation officer does not automatically indicate that the foreign buyer also knew about the non-compliant transaction or knowingly participated in it. An investor may have concluded that the transaction was duly carried out upon seeing that the immovable property was registered in their name in the title registry, the consideration was remitted through a bank, and a conformity certificate was issued by the official authorities. Such good faith and state of knowledge must be evaluated together with other evidence.<\/p>\n<p>On the other hand, merely stating that \"I left all transactions to the advisor\" does not constitute a sufficient explanation in every file. It is investigated which documents the investor signed, whether they personally carried out the transfers, how they were informed about the pricing, and what commitments were made to them during the transactions. For the buyer, it is important both to prove a lawful investment and to clarify any personal connection to the transactions in question, if any.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Yatirim_Yoluyla_Kazanilan_Vatandasligin_Iptali_Es_ve_Cocuklari_Etkiler_mi\"><\/span>Does the Revocation of Citizenship Acquired Through Investment Affect the Spouse and Children?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Pursuant to Article 32 of Law No. 5901, the annulment decision takes effect as of the date of the decision and may also apply to the spouse and children who have acquired Turkish citizenship through the relevant person. Therefore, the actions of the primary investor may also produce consequences regarding family members who acquired citizenship through them. However, if the family members' citizenship is based on an independent legal ground or if the procedure to be applied is of a different nature, this situation must be examined separately.<\/p>\n<p>It is incorrect to assume that everyone in a family became a Turkish citizen on the same date and for the same legal reason. The spouse having their own investment, the child acquiring citizenship by birth, different citizenship decisions, or subsequent family law transactions may lead to different outcomes. Especially in lawsuits to be filed on behalf of minor children, the representation authority and the specific transaction being challenged must be clearly determined.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Vatandaslik_Iptal_Edilirse_Tapu_ve_Tasinmaz_Ne_Olur\"><\/span>What Happens to the Title Deed and Real Estate if Citizenship is Revoked?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>An administrative decision regarding citizenship status does not mean that the title deed registration of the purchased real estate is automatically deleted. However, the revocation of citizenship may create separate problems due to restrictions on the acquisition of real estate by foreigners, the nationality of the relevant person, the location of the real estate, administrative liquidation provisions, or protective measures applied in the criminal case file.<\/p>\n<p>Article 33 of Law No. 5901 contains special provisions regarding the liquidation of assets with respect to certain persons whose citizenship has been revoked. It cannot be concluded from this that all real estate must be sold immediately in every citizenship revocation; whether liquidation is required, the content of the decision, and whether there is a pending lawsuit must be examined. Final and executive administrative decisions regarding the revocation or withdrawal of Turkish citizenship may be subject to an annulment lawsuit in the competent judicial authority. Nevertheless, <strong>merely being invited to give a statement yet<\/strong>, does not mean that there is a citizenship decision that can be the subject of an annulment lawsuit. First, it must be determined whether the transaction has actually been executed, by which authority it was issued, its grounds, and the date of proper service.<\/p>\n<p>In administrative judiciary, the general filing period is, as a rule, 60 days from written notification, unless a special period is stipulated. However, the competent and authorized court may vary depending on the nature of the authority that executed the transaction; for certain citizenship proceedings, the first-instance jurisdiction of the Council of State (Dan\u0131\u015ftay) may come into question. It is incorrect to automatically state that \"a lawsuit is filed in the Istanbul Administrative Court\" without seeing the decision. Furthermore, filing a lawsuit does not automatically stay the execution of the transaction in every case; if the conditions are met, a stay of execution must be requested.<\/p>\n<p>In a request for a stay of execution, it is important to document not only the allegation that the decision is unjust, but also the clear violation of law and the damages that are difficult or impossible to compensate which may arise if the decision is implemented. Family unity, children's education, working and commercial life, travel opportunities, and passport and civil registry records can be substantiated within this scope.
