In this process, an apostille endorsement, consular legalization, Turkish translation, and, when necessary, notary attestation may be required.

However, it is incorrect to state that the exact same procedures are mandatory for every foreign document. The country of issuance, international conventions between Turkey and that country, the type of document, and the specific rules of the institution where the document will be submitted must be evaluated together.

The primary legal bases for the use of foreign official documents in Turkey are the Code of Civil Procedure (HMK) No. 6100, the Code on Private International Law and Procedural Law (MÖHUK) No. 5718, the Hague Apostille Convention dated October 5, 1961, and relevant notarial legislation.

1. Legal Basis for the Validity of Foreign Official Documents in Turkey

The use of a document issued by a foreign authority as an official document in Turkey may require the document to be duly authenticated. Nonetheless, the legalization of a document, the accuracy of its content, and the legal consequences it will produce in Turkey are distinct matters.

1.1. Article 224 of HMK: Evidentiary value of foreign official documents

Article 224 of the Code of Civil Procedure No. 6100 regulates the attestation requirement for official documents prepared by foreign state authorities to possess the character of official documents in Turkey. The second paragraph of the article states that the provisions of international conventions to which Turkey is a party regarding the legalization of foreign official documents are reserved.

Due to this regulation, not only general statutory provisions but also applicable international conventions must be taken into account when using foreign official documents in Turkey. In cases where the apostille procedure is applicable, the simplified method stipulated in the convention may be used instead of the traditional consular legalization chain.

For the current text of the legislation Legislation Information System Code of Civil Procedure No. 6100 can be reviewed via .

1.2. MÖHUK Art. 7: Form of legal transactions

Article 7 of the Law on Private International Law and Procedural Law No. 5718 regulates the law applicable to the form of legal transactions. Accordingly, legal transactions may be executed in compliance with the form prescribed either by the law of the country where they are performed or by the substantive law provisions governing the merits of the transaction.

However, the formal validity of a document under the law of the country where it was issued does not mean that the document can be used in every transaction in Turkey without any additional conditions. The purpose of using the document in Turkey, legalization requirements, and the specific formal requirements of the relevant transaction must be evaluated separately.

2. What is an Apostille Endorsement?

An apostille is a certification endorsement used within the scope of the Hague Convention Abolishing the Requirement of Legalisation for Foreign Public Documents dated October 5, 1961. Where the Convention applies, an apostille replaces the traditional chain of diplomatic or consular legalization.

An apostille essentially verifies the authenticity of the signature on the document, the capacity in which the person signing acted, and, where applicable, the identity of the seal or stamp on the document. It does not by itself prove that the content of the document is accurate, that the events stated in the document actually occurred, or that the document is valid in all circumstances under Turkish law.

2.1. Which documents may fall within the scope of an apostille?

Within the scope of Article 1 of the Hague Convention, the following types of public documents are generally subject to the apostille procedure:

Documents originating from courts and other judicial authorities,

Public documents issued by administrative authorities,

Notarial acts,

Official annotations verifying details such as signatures or records on documents signed by private individuals.

The Convention contains exclusion provisions regarding documents issued by diplomatic or consular agents, as well as certain administrative documents directly related to commercial or customs operations. Therefore, it should not be assumed that every invoice, commercial document, or consular document is eligible for an apostille.

For the scope and exceptions of the Convention the official text of the Hague Apostille Convention may be examined.

2.2. In which countries can an apostille be used?

Whether the apostille procedure applies depends on the status of the Convention's entry into force between the country where the document was issued and Turkey, and whether the document falls within the scope of the Convention. Since countries' accession statuses to the Convention may change over time, outdated country lists should not be relied upon.

Prior to the transaction the up-to-date table of contracting states of the Hague Conference on Private International Law must be checked. In addition, it should be investigated whether the accession has entered into force in relations between the two states and whether there are any special regulations regarding the relevant document type.

3. Consular Legalization When an Apostille Does Not Apply

In cases where the document is not eligible for the apostille regime, consular or diplomatic legalization procedures may be required for its use in Turkey. The procedure to be followed may vary depending on the practice of the country where the document was issued and the regulations between Turkey and that country.

In the traditional legalization process, generally the following stages may apply:

Issuance of the document: The document must be issued or duly certified by the competent authority in the respective country.

Local authority verification: To verify the signature and seal of the issuing authority, application is made to the competent certification authority in the respective country.

Ministry of Foreign Affairs or competent authority certification: Depending on the practice of the respective country, approval is obtained from the ministry of foreign affairs or another authorized institution.

Certification by the Turkish diplomatic mission: If required by the relevant procedure, the certification of the document by the consular authority of the Republic of Turkey is completed.

These stages are not identical for every country and document. Bilateral agreements or other international conventions between the country where the document is issued and Turkey may exempt certain certification procedures or provide for a different procedure.

To obtain information regarding notarization and certification procedures to be performed abroad, the Republic of Turkey Ministry of Foreign Affairs Consular Affairs system may be used.

4. Translation of Foreign Documents into Turkish and Certification

A Turkish translation may be required for a document drafted in a foreign language to be used in Turkey. Whether the translation must be performed by a sworn translator, notarized, or certified by a consulate must be determined in accordance with the rules of the institution where the document will be submitted and the nature of the transaction.

4.1. Generally, this entails the submission of the duly certified original or copy of the foreign court decree, the document showing that the judgment is final, and their duly certified translations.

However, it should not be inferred from this provision that an apostille must invariably be obtained in the exact same manner in every file. The certification procedure of the document must be determined within the framework of conventions between the relevant country and Turkey, as well as other applicable rules. An apostille does not replace other conditions required for recognition or enforcement.

Regarding the legal transactions of foreign companies in Turkey explanations regarding the establishment of branches or liaison offices by foreign companies in Turkey can also be examined.

5.3. Foreign company documents and trade registry records

With respect to documents submitted by foreign companies for company establishment, branch or liaison office proceedings, representation authority, or commercial applications in Turkey, the currency of the document, the issuing authority, and records demonstrating representation authority are of importance.

The certification method to be applied for a certificate of good standing (certificate of activity), company registry record, certificate of incorporation, board of directors resolution, or document demonstrating signature authority must be determined according to the source of the document, relevant international regulations, and the nature of the transaction.

The fact that a foreign document has been certified does not mean that the company representative's authority is sufficient for every transaction. The content of the document, the scope of representation authority, and the conditions required by relevant Turkish legislation must be evaluated separately.

5.4. Birth, marriage, and death certificates

In civil status documents such as birth, marriage, and death records, international conventions in force between the country where the document was issued and Turkey are of importance. Certain multilingual record exemplars may be exempt from the requirement of an apostille or translation pursuant to the terms of the relevant convention.

However, this exemption does not apply to birth, marriage, or death certificates obtained from all countries. The type of document, the issuing country, and the applicable convention must be verified. The current acceptance conditions of the relevant civil registry office or other competent authority must also be taken into consideration.

6. Certain documents may be subject to different certification procedures or be exempt under international regulations.

Does an apostille prove that the contents of the document are accurate?

No. An apostille primarily verifies the authenticity of the signature, the capacity in which the person signing acted, and, where appropriate, the identity of the seal or stamp. It does not independently guarantee the accuracy of the document's content or the transaction's compliance with Turkish law.

Is a Turkish translation required for an apostilled document?

A Turkish translation may be requested depending on the rules of the institution where the document will be submitted. Whether the translation must be performed by a sworn translator and subjected to notary or consular approval must be determined based on the nature of the document and its intended use.

Can a power of attorney issued in a foreign country be used in Turkey?

Yes, it can be used provided that the relevant formal and certification requirements are met. However, the scope of the power of attorney, special powers, and the formal requirements necessary for the transaction in which it will be used must also be checked. Where appropriate, it is also possible to carry out notarization procedures at Turkish consulates.

Is an apostille sufficient for a foreign court judgment to be valid in Turkey?

It is not always sufficient. If the recognition or enforcement of the judgment in Turkey is required, MÖHUK and the relevant procedural provisions shall apply. An apostille or other certification procedure does not replace the other conditions required for recognition or enforcement.

Must the certificate of finalization of the foreign court judgment also be submitted?

In recognition or enforcement applications, the document showing that the judgment is final may be of importance. The required documents must be checked pursuant to Article 53 of MÖHUK and the nature of the specific judgment.

Can an e-Apostille be used in Turkey?

Electronic apostille applications are evaluated within the framework of the system of the country where the document was issued and the acceptance conditions in the country where the document will be used. The verifiability of the document and the acceptance conditions of the institution to be applied to must be checked prior to the transaction. Regarding the e-Apostille application in Turkey the official statement of the Ministry of Justice may be examined.

Is there a validity period for an apostille annotation?

The Hague Apostille Convention does not prescribe a general expiration period for an apostille certificate. However, there may be specific conditions depending on the currency of the underlying document, the rules of the receiving institution, or the nature of the document. Whether the document and the apostille will be accepted for a specific transaction must be evaluated on a case-by-case basis.

10. Conclusion

A single certification method does not apply to all situations for the use of documents issued abroad in Türkiye. Apostille, consular legalization, and translation requirements must be determined by jointly evaluating the country of issuance, the nature of the document, applicable international conventions, and the rules of the institution where the document will be submitted.

Particularly for foreign court judgments, powers of attorney, and corporate documents, completing the certification process alone may not be sufficient. The content of the document, formal requirements, representation authority, and the conditions of the requested legal outcome must be separately examined.

Author Information

Atty.
