The decision is discussed solely for the purpose of examining its legal grounds and practical importance, without sharing information that could reveal the identity of the relevant person.

How Did the Dispute Arise?

An administrative proceeding was initiated against the plaintiff on the grounds that there was no record of lawful entry into Turkey and that the rules of lawful entry and exit were violated. By its decision dated September 15, 2022, the Istanbul Provincial Directorate of Migration Management ordered the deportation of the foreigner pursuant to Article 54/1-(h) of the Law on Foreigners and International Protection No. 6458.

The plaintiff's party asserted that, due to current political and security conditions in Afghanistan, they could not return to their country, that their life safety would be endangered if removed, and that the deportation proceeding violated the principle of non-refoulement. No statement of defense was submitted to the case file by the defendant administration.

The primary issue to be resolved by the Court does not merely consist of whether a foreigner deemed to have violated the provisions on lawful entry into Turkey can be deported. The core dispute is whether, even if a statutory ground for deportation has arisen, sufficient investigation was conducted regarding the principle of non-refoulement prior to the plaintiff's removal to Afghanistan.

Did the Court Reject the Allegation of Illegal Entry?

No. The Court acknowledged that the ground capable of serving as the basis for issuing a deportation order against the plaintiff had materialized. The decision does not contain a conclusion to the effect that “a deportation order cannot be issued against a foreigner who enters Turkey illegally”.

Article 54/1-(h) of Law No. 6458 regulates the issuance of deportation orders against foreigners who violate or attempt to violate the provisions concerning lawful entry into or lawful exit from Turkey. Rather than declaring the entire country safe or unsafe, the specific region to which the foreigner will be sent and their personal characteristics may also be included in the evaluation.

Research title

Matters that may be examined

Up-to-dateness

Political, military, and humanitarian developments close to the date of the decision

Source reliability

Official institutions, international organizations, and reliable country reports

Geographical scope

Differences between the country as a whole and the specific region to which the foreigner may be sent

Personal risk

Political opinion, social group, ethnic or religious affiliation, profession, gender, and past events

Accessibility

Whether the foreigner can be safely admitted to the destination country

Justification

Establishing a clear connection between general country information and the individual's claims

Why Was the Administration's Research Found Insufficient?

In the deportation proceedings, it was stated that there is no legal impediment under Articles 4 and 55/1-(a) of Law No. 6458 regarding the claimant's removal to Afghanistan. However, the court found that it was not demonstrated which current country information led to this conclusion, nor how the risk to the right to life asserted by the claimant was evaluated.

According to the court, taking into account the current stage of the situation in Afghanistan, whether sending the claimant back to their country poses a risk of producing a negative impact on the right to life should have been investigated at a legally acceptable and sufficient level. The deportation decision rendered without clarifying this issue lacked lawfulness.

The court accepted that the grounds for deportation had materialized; however, because the necessary risk assessment regarding the country to which the foreigner would be sent was not completed, it found the administrative act unlawful with respect to the "subject matter" element.

Are General Conditions in Afghanistan Sufficient on Their Own?

The decision does not establish an absolute rule that every Afghan citizen can under no circumstances be deported. While general country conditions are important, the foreigner's personal claims, background, the region to which they will be sent, and current country information must be evaluated together in the review of the prohibition of refoulement.

On the other hand, it cannot be said that every abstract risk claim raised by the foreigner automatically renders the deportation order invalid. The applicant must explain and support their claims to the extent possible, and the administration must ex officio investigate these claims with current, reliable, and relevant information. The two obligations are not alternatives to each other.

Are the Principle of Non-Refoulement and International Protection the Same Thing?

No. The prohibition of refoulement is a fundamental protection ensuring that sending a person to a specific country is prevented with respect to the right to life or the prohibition of ill-treatment. International protection, on the other hand, is a separate legal mechanism encompassing application, evaluation, and status procedures within the scope of Law No. 6458.

The annulment of a deportation decision does not automatically grant the foreigner international protection status or a residence permit. Likewise, the absence of an international protection application does not entirely eliminate the administration's obligation to assess the prohibition of refoulement ex officio. The foreigner's subsequent legal status in Turkey is determined under separate procedures.

In some cases where departure from Turkey cannot be enforced due to the prohibition of refoulement, a humanitarian residence permit may additionally come into question. However, this permit and the annulment of the deportation decision are distinct legal proceedings. Batın Yılmaz the distinguishing aspect of the decision is that it reviews the deportation procedure in two separate stages. The court first accepted that the ground for deportation materialized due to the violation of legal entry provisions, and subsequently stated that this acceptance does not eliminate the review of the principle of non-refoulement.

In deportation lawsuits, merely objecting to the subparagraph of Article 54 upon which the act is based may not be sufficient. The country of destination, the date and sources of the country of origin research, the individual risks of the foreigner, the justification in the administrative assessment, and how Articles 4 and 55 of the Law are applied to the specific case must be examined separately. Since the evidence and target country conditions of each file differ, this decision does not constitute a guarantee of outcome.

Frequently Asked Questions

Who should conduct the country of origin research?

Pursuant to the Implementing Regulation, risks under the principle of non-refoulement must be investigated ex officio by the governorship prior to deportation or removal from the country. While the violation of legal entry provisions may constitute grounds for deportation, no one can be sent to a place where there is a risk of torture or a threat to the right to life. An individualized assessment must be made for each foreigner.

Is a deportation decision annulled if the country of origin report is outdated?

The use of an outdated report does not automatically result in annulment in every case. However, if conditions in the destination country have changed significantly, obsolete information may not be sufficient to assess the actual risk. The Administration must clarify whether sending the individual to Afghanistan would have a negative impact on the right to life through an up-to-date, legally acceptable, and sufficient country of origin information (COI) research.

In the specific case, merely stating that there is no obstacle to deportation without conducting this research was not deemed sufficient.
