This act is explicitly regulated under Article 121 of the Turkish Penal Code (TCK).

The right to petition is one of the fundamental legal remedies in a state governed by the rule of law. Individuals may submit written applications to public institutions for requests, complaints, objections, requests for information, or to seek legal remedies concerning themselves. The duty of the state is not to arbitrarily close this avenue of application or render the individual unable to reach the competent authority.

Therefore, the refusal of a petition by an officer or public official without legal basis through an attitude such as "I am not receiving it," "I am not registering it," "I do not accept documents," or similar stances is not merely an administrative fault; if the conditions are met, it is also a crime under criminal law may constitute.

. The point to be noted here is this: Not every deficient transaction or failure to respond automatically falls within the scope of TCK Article 121. The primary focus of the article is the outright refusal to accept the petition. In other words, the crime arises if an individual wishes to make a written application to exercise their right, but the public authority avoids receiving this application without a legally valid reason.

What Does Article 121 of the TCK Protect?

The primary legal value protected by this type of crime is the freedom to seek legal remedies and consequently right to petitionis. Because an individual's ability to apply to public authorities is often the first step in exercising other rights.

For example, an individual may:

apply for social assistance,

initiate zoning or permit procedures,

file a disciplinary or administrative complaint,

request compensation for a loss,

submit a notification to initiate a criminal investigation

submit a petition for the purpose of. The rejection of a petition does not merely mean that the document is not accepted; in most cases, it results in the individual's right to seek legal remedy being effectively blocked .

Therefore, although TCK 121 is technically a brief provision, in practice it provides protection of high constitutional importance. It is specifically aimed at preventing arbitrary actions by public officials.

Elements of the Crime of Prevention of the Exercise of the Right to Petition

What Conditions Are Required for the Offense to Occur?

In order for the offense to occur within the scope of TCK 121, the following conditions must generally be met together:

1. There Must Be a Petition

The application must be in the nature of a written petition. Verbal grievances, telephone applications, or daily statements lacking an official character are not evaluated within this scope. The written nature of the petition is also important in terms of proof.

2. The Petition Must Be Intended to Be Submitted to a Competent Public Authority

The petition must be addressed to a public authority that has the duty to take action on the relevant subject or is obliged to accept the application. The issue of jurisdiction is important in practice. However, pursuant to Law No. 3071, a petition submitted to the wrong authority, instead of being completely rejected, must as a rule be forwarded to the relevant authority.

3. The Petition Must Be Submitted for the Exercise of a Specific Right

The text of the article specifically includes the phrase "for the exercise of a specific right." Therefore, every written text that is merely irrelevant, abstract, vague, or not tied to the exercise of a right is not evaluated within the scope of TCK 121. The petition must carry the purpose of a request, application, complaint, objection, or seeking legal remedies.

4. The Petition Must Not Be Rejected Without a Legal Ground

This is the backbone of the crime. If the public official has no legally valid reason, and still refuses to accept it, the crime may be constituted. Conversely, if there is a clear and legitimate ground for refusal arising from the law, TCK 121 may not apply.

What Does "Without Legal Justification" Mean?

The phrase "without legal justification" means that the conduct of the public official is arbitrary . In other words, the act of refusal must not be based on a statutory provision, procedural rule, or valid regulatory basis.

By way of example, the following situations may be discussed:

the petition not being accepted simply because the agency official does not want to take it,

being told "we are not accepting them today" despite applying during working hours,

the application not being recorded, [or]

the applicant being turned away without any justification being provided.

effectively denying the person the opportunity to apply by refusing to accept the petition.

On the other hand, in some cases, a rejection may rest on a legally debatable ground. For instance, if the petition completely lacks mandatory elements, if there is no systemic acceptance procedure regarding the addressee, or if an explicit formal requirement is stipulated by law, the specific incident shall be evaluated separately. However, even in such cases, the administration is expected to act proportionally and, if possible, allow the deficiency to be remedied or direct the petition to the correct authority.

Who Can Be the Perpetrator of the Offense?

In practice, the perpetrator of this offense is mostly a public official . This is because the authority to accept petitions or record documents is typically exercised through public authorities and their officials.

What is important here, rather than the person's official title, is whether they possess the de facto or legal authority to accept or reject the application in the specific case. An official working in the document registration unit, an intake clerk, prison administration personnel, or relevant desk officer may qualify as a perpetrator depending on the circumstances.

Who is the Victim of the Offense?

The victim is the person who wishes to submit a petition to exercise a certain right. This person may be:

a citizen,

a foreigner residing in Turkey,

in certain cases, a legal entity representative.

it is possible. The core issue is the prevention of a right to petition that is legally worthy of protection.

Penalty for the Crime of Prevention of the Exercise of the Right to Petition

What is the Penalty According to TCK Article 121?

According to Article 121 of the Turkish Penal Code, in the event that the exercise of the right to petition is prevented, the perpetrator shall be sentenced to imprisonment for up to six months .

The upper limit of the sentence is determined in the article. The amount of the sentence may vary depending on the specifics of the concrete case, the intent of the perpetrator, the manner in which the crime was committed, and evaluations during the judicial process.

Can It Be Converted into a Judicial Fine?

The answer to this question may vary depending on the specifics of the concrete case. The court makes an evaluation taking into account the duration of the sentence to be imposed, the defendant's background, personal traits, and other criminal law institutions. However, in general, for short-term prison sentences, different sanction mechanisms may come into play if the conditions are met.

Nevertheless, what is truly important in practice is the correct legal characterization of the incident. This is because citizens sometimes state, "They did not process my petition," whereas legally the matter might constitute a completely different crime, a disciplinary violation, or an administrative procedural defect rather than TCK Article 121.

In Which Circumstances Does TCK Art. 121 Apply?

Outright Rejection of the Petition

This is the most typical scenario. An individual submits their petition, but the official refuses to accept the application without citing any legal basis. No record is created, no receipt is issued, and the petition is not entered into the system physically or electronically. In this case, TCK Article 121 may directly apply.

Intentional Delay of the Petition

In legal doctrine, particularly in time-sensitive procedures, the fact that a petition is submitted on time but its acceptance is intentionally delayed is also considered significant in terms of the offense. This is because, even though there appears to be an acceptance on the surface, the individual's exercise of rights is actually being prevented.

For instance, intentionally logging a petition submitted on the final deadline date on the following day may cause the individual to suffer a loss of rights. In such cases, criminal liability may be evaluated separately based on the specific circumstances of the incident.

Application in Prisons, Administrative Institutions, and Complaint Applications

In practice, this offense gains particular importance in the following areas:

applications by convicts and detainees in prisons,

municipality and district governorship applications,

university and public institution complaints,

social security and assistance applications,

disciplinary or administrative investigation requests.

The failure to accept such applications results not merely in individuals being unable to submit a document, but frequently in their inability to access fundamental rights.

In Which Circumstances Might TCK Art. 121 Not Constitute an Offense?

If the Petition Was Accepted But No Action Was Taken Afterward

This point is of utmost importance. If the petition has been accepted, recorded, and even assigned a receipt number, but the institution subsequently fails to take the required action, this situation is not always evaluated within the scope of TCK 121.

Because the wording of the article essentially penalizes "refusal of acceptance." On the other hand, the failure to take action after the petition has been received, depending on the specifics of the case, may constitute:

a deficiency in administrative proceedings,

service defect,

disciplinary liability,

may give rise to other similar legal disputes concerning misconduct in office

.

If There Is a Legally Valid Ground for Rejection

If the institution has a statutory justification for refusal, TCK 121 does not apply automatically. However, this ground must genuinely be legal, proportionate and concrete . Arbitrary practices do not constitute legal grounds.

Oral Applications

Since the article explicitly refers to a "petition", written application is essential. The complete failure to accept an oral application may give rise to other issues; however, for an evaluation to be made directly under TCK 121, the existence of a written petition element is required.

What Should Be Considered When Submitting a Petition?

The Safest Methods for Burden of Proof

If an allegation will be made regarding the prevention of the exercise of the right to petition, proof is of utmost importance. Therefore, the following methods should be preferred as much as possible when making an application:

Obtain a Document Registration Number upon Hand Delivery

When submitting your petition, make sure to request a registration number or a receipt document.

Have a "Received" Stamp Placed on a Copy

Obtaining a date, stamp, and signature on your second copy constitutes strong evidence in any subsequent disputes.

Use KEP, UETS, or Official Electronic Application Systems

Electronic application systems are highly effective in technically proving that the application has reached the institution.

Consider the Notary Public or Registered Mail Option

Particularly in cases involving critical statute of limitations periods, methods utilizing a notary public or registered mail with return receipt can increase evidentiary weight.

What Can Be Done in Case of Prevention of the Right to Petition?

Criminal Complaint / Reporting of a Crime

Although the prosecution procedure for this offense is evaluated separately based on the specifics of the concrete case, in practice, the individual generally File a criminal complaint with the Office of the Chief Public Prosecutor. The petition must clearly explain on what date, to which institution, by whom, and for what reason it was not accepted.

Administrative Application and Complaint to the Superior Authority

Internal institutional review mechanisms may also be utilized. A complaint may be filed with the superior authority, the governorate, the district governorate, the ministry, or the relevant auditing unit. Disciplinary liability may arise concerning the public official.

Institution of the Ombudsman and Administrative Judicial Remedies

Depending on the specific circumstances of the case, alternative application remedies against the administrative action or omission may also come into question. Particularly if a loss of rights has occurred due to the non-acceptance of the application, administrative jurisdiction and other oversight mechanisms must also be considered.

Frequently Asked Questions

1) What is the prevention of the exercise of the right to petition?

It is the refusal to accept a petition submitted by an individual to a competent public authority to exercise a specific right, without any legal justification. This act is regulated as a crime under Article 121 of the TCK.

2) What is the penalty under Article 121 of the TCK?

Pursuant to the article, regarding the perpetrator imprisonment for up to six months it is envisaged.

3) Does the failure to respond to a petition also constitute this crime?

Not always. TCK 121 primarily regulates the rejection of the petition situation. If the petition was received but no response was provided subsequently, different legal remedies and types of liability may arise.

4) Can a petition submitted to the wrong institution be rejected?

Pursuant to Law No. 3071, a petition submitted to an administrative authority lacking jurisdiction must be forwarded to the competent authority, and the applicant must be informed. Therefore, a direct arbitrary rejection is not deemed acceptable.

5) Does TCK 121 apply if a verbal application is not accepted?

Since the article is based on the "petition" principle, written applications are crucial. The same assessment may not directly apply to verbal applications.

6) What should I do if I believe my right to petition has been obstructed?

Document the incident if possible; if an receipt was not issued, gather witnesses, security footage, emails, KEP (registered electronic mail), notary, or postal records. Subsequently, depending on the specific circumstances, a criminal complaint may be filed with the prosecutor's office, and an administrative complaint may be lodged with the relevant institution.

Atty.
