Such interventions are generally medical procedures and in most cases require expertise, technical conditions, and recording\/monitoring.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2) The Element of Consent (Informed Consent)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The statutory text explicitly uses the concept of \"consent\". In practice,&nbsp;<strong>consent<\/strong>is not merely saying \"yes\"; it requires the individual to fully understand:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the nature of the intervention,<\/li>\n\n\n\n<li>its consequences (including permanence),<\/li>\n\n\n\n<li>its alternatives,<\/li>\n\n\n\n<li>its risks<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">making a decision by understanding. ECHR case law also in sterilization&nbsp;<strong>informed consent<\/strong>&nbsp;reinforces the emphasis (V.C. v. Slovakia judgment).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3) Condition of Being Performed by an Authorized Person<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The focus of TCK Article 101\/2 is as follows:&nbsp;<strong>Even if consent exists<\/strong>, sterilization&nbsp;<strong>by an unauthorized<\/strong>&nbsp;person constitutes a crime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The main justification for this approach is: Sterilization is a severe and irreversible intervention in terms of its consequences; therefore, only&nbsp;<strong>legally and professionally authorized<\/strong>&nbsp;must be performed by persons under health conditions compliant with the legislation.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Penalty for the Crime of Sterilization Without Consent<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What is the prison sentence for sterilization without consent?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to TCK Article 101\/1:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Sterilization without consent<\/strong>\u00a0the person who performs\u00a0<strong>imprisonment from 3 to 6 years<\/strong>\u00a0shall be punished.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Is the penalty increased if performed by an unauthorized person?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yes. According to the same paragraph:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Act\u00a0<strong>not authorized to perform the sterilization procedure<\/strong>\u00a0if performed by a person,<\/li>\n\n\n\n<li>penalty to be imposed\u00a0<strong>it shall be increased by one-third.<\/strong><\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Sterilization Performed by an Unauthorized Person Even with Consent<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Why is it a crime if there is consent?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The rationale behind TCK Article 101\/2 is as follows: Even if the individual consents, if such a major medical intervention as sterilization is&nbsp;<strong>unauthorized<\/strong>&nbsp;persons are performed by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>patient safety,<\/li>\n\n\n\n<li>medical standards,<\/li>\n\n\n\n<li>records\/traceability,<\/li>\n\n\n\n<li>capacity to intervene in complications<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">it creates serious risks in areas such as these. Therefore, the law does not consider the act lawful merely because consent exists.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What is the penalty under TCK Article 101\/2?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Imprisonment from 1 to 3 years<\/strong>\u00a0.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>When Can Sterilization Be Legally Performed?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition to the penal judgment, Article 4 of Law No. 2827 states:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Sterilization surgery<\/strong>, if there is no medical contraindication, <strong>upon the request of an adult individual<\/strong>\u00a0is conducted.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This framework highlights two important points in practice:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>In minors<\/strong>\u00a0and\/or in cases where legal capacity is disputed, the issue of consent becomes more complex.<\/li>\n\n\n\n<li>Obtaining \u201crequest\u201d and \u201cconsent\u201d\u00a0<strong>in due form<\/strong>\u00a0(informed consent, documentation, record-keeping, physician evaluation) is of critical importance.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Furthermore, the same article stipulates that in certain cases of medical necessity, intervention regarding \"castration\" may be performed without seeking consent; however, this is a highly exceptional situation requiring medical necessity (Law No. 2827, Art. 4).<\/em><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Key Practical Considerations in the Crime of Sterilization<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Is \"consent\" truly valid?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some of the controversial issues in practice include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Whether consent\u00a0<strong>was obtained<\/strong>\u00a0under duress<\/li>\n\n\n\n<li>Whether the individual\u00a0<strong>was sufficiently informed while giving consent<\/strong><\/li>\n\n\n\n<li>Whether the permanent outcome of the sterilization was understood<\/li>\n\n\n\n<li>The content of medical records and informed consent forms<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Frequently Asked Questions (FAQ)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1) Is the crime of sterilization subject to a complaint?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 101 of the TCK does not explicitly regulate the condition of a complaint. In such offenses, the process is generally evaluated within the scope of ex officio investigation depending on the nature of the crime.
