Batın YILMAZ

Foreign nationals can get a divorce in Turkey. The fact that both spouses are foreign nationals or that only one spouse is a Turkish citizen does not, by itself, prevent the filing of a divorce lawsuit in Turkish courts. In cases where Turkish courts have international jurisdiction, a divorce lawsuit may be filed in the family court in Turkey. If there is a final and binding divorce decree rendered abroad, direct application for registration in the civil registry, a recognition lawsuit, or an enforcement lawsuit comes into question, depending on the nature of the decision and the status of the parties.

In international divorce disputes, three issues must be distinguished from one another: the jurisdiction of Turkish courts to hear the case, the law of which country will be applied to the divorce, and the method by which a divorce decree rendered in a foreign country will take effect in Turkey. Proceeding without making this distinction under the sole heading of "divorce in Turkey" may lead to consequences such as applying to the wrong court, missing documents, loss of time, or failure to update civil registry records.

Basic Legal Framework for Divorce of Foreigners in Turkey

The primary regulation in foreign-element divorce lawsuits is the Code on International Private Law and Procedure numbered 5718. Article 40 of the Code accepts that the international jurisdiction of Turkish courts shall, as a rule, be determined according to the rules of venue based on location in Turkish domestic law.

The law applicable to the grounds and consequences of divorce and separation is pursuant to Article 14 of Code No. 5718 is determined. Accordingly, the general ranking is as follows:

If the spouses share a common citizenship, their joint national law shall apply.

If the spouses have different citizenships, their joint habitual residence law shall apply.

If there is no common habitual residence either, Turkish law shall apply.

This provision indicates that the jurisdiction and competence of the Turkish court in a divorce case filed by foreign nationals in Turkey does not mean that Türk Medeni Kanunu provisions will apply in every case. The Turkish court may hear the case; however, foreign law may need to be applied regarding the grounds for divorce and certain consequences.

Nevertheless, Turkish law applies to interim measures concerning the shelter, livelihood, management of property of the spouses, and the protection of children while the divorce proceedings are pending.

What Does Habitual Residence Mean?

Habitual residence is not merely the place where a person is staying temporarily. The place where a person's family, employment, education, social environment, and daily life relationships are de facto centralized is accepted as the habitual residence.

For example, the mere existence of a residence permit in Turkey for a foreign spouse does not in itself lead to the conclusion that Turkey is the common habitual residence. The actual place where the parties reside, where the children's education continues, in which country business relations are located, lease or property relations, and the center of family life are evaluated together.

Therefore, especially for spouses who maintain a regular life between Turkey and another country, the determination of habitual residence is of a nature that can affect the outcome of the lawsuit.

Divorce in Turkey When Both Spouses Are Foreign Nationals

The fact that both spouses are foreign citizens does not prevent the filing of a divorce lawsuit in Turkey. However, Turkish courts must have international jurisdiction in the specific case.

In terms of filing for divorce in Turkey, the most common jurisdictional connections are as follows:

One of the spouses having a domicile in Turkey,

The parties having lived together in Turkey for the last six months prior to the lawsuit,

The common life having been established or maintained in Turkey,

The children residing in Turkey and there being a need for urgent protective measures,

One of the parties having a permanent residence, employment, or family life connection in Turkey.

Pursuant to TMK art. 168 in a divorce or separation action, the competent court is the court of the place of domicile of either spouse or the court of the place where they have resided together for the last six months prior to the lawsuit.

Applicable Law for Foreign Spouses Sharing the Same Nationality

If both spouses are citizens of the same foreign state, that state's law shall primarily apply regarding the grounds and consequences of the divorce.

For instance, in the event that two German citizens file for divorce in Turkey, the Turkish court may have international jurisdiction; however, German law may need to be applied with respect to the grounds for divorce, fault assessment, or certain claims ancillary to the divorce.

In such lawsuits, it is crucial that the content of the foreign law is determined by the court. It may facilitate the proceedings for the parties to submit the current text of the applicable foreign law and, where necessary, expert opinions.

Evidence in Divorce Actions Filed in Turkey

Although the principle of freedom of evidence applies in divorce cases filed by foreign spouses, every fact must be substantiated with lawfully obtained evidence. Therefore, to prevent the risk of loss of rights, deadlines—particularly regarding property regimes and claims for compensation arising from divorce—must be examined without delay.

Conclusion

Divorce proceedings for foreign nationals in Turkey consist of interconnected legal topics such as citizenship, habitual residence, international jurisdiction of the court, applicable law, status of children, and the recognition of foreign judgments in Turkey.

If a new divorce action is to be filed in Turkey, the jurisdiction of Turkish courts and the law applicable to the divorce must first be determined. If there is a final divorce judgment rendered abroad, an evaluation must be made as to whether the decision is a court judgment, an administrative decision, or a notary act, and whether it contains only the divorce ruling or also alimony, compensation, or custody obligations that require enforcement.

Direct registration in the civil registry, recognition, and enforcement procedures are not identical. The appropriate legal path must be determined based on the country where the decision was rendered, the manner in which the decision became final, the residence status of the parties in Turkey, the documentary infrastructure, and the desired legal outcome in Turkey. Mentioned in this article legal processes regarding Turkish citizenshipare significant with respect to remarriage after divorce, property regimes, and inheritance.

About Us – Contact Information

Atty.
